According to this legal framework, <strong data-start=\"1571\" data-end=\"1606\">participation alimony in Turkey<\/strong> is defined as the <strong data-start=\"1625\" data-end=\"1801\">type of alimony paid by the parent who is not granted custody to the custodial parent, in order to contribute to the child\u2019s expenses following a divorce or separation case<\/strong>.<\/p>\n<p data-start=\"1804\" data-end=\"2183\">Through this alimony, the <strong data-start=\"1830\" data-end=\"2028\">non-custodial parent is obliged to contribute, in proportion to their financial capacity, to the child\u2019s essential needs such as healthcare, education, housing, clothing, and similar necessities<\/strong>. In this way, the aim is to <strong data-start=\"2057\" data-end=\"2182\">preserve, as much as possible, the economic conditions that the child enjoyed during the continuation of the family union<\/strong>.<\/p>\n<p data-start=\"2185\" data-end=\"2791\" data-is-last-node=\"\" data-is-only-node=\"\">On the other hand, if <strong data-start=\"2207\" data-end=\"2252\">temporary child support <\/strong>has been awarded by the court <strong data-start=\"2283\" data-end=\"2371\">in favor of the child during the ongoing divorce or separation proceedings in Turkey<\/strong>, such support may <strong data-start=\"2390\" data-end=\"2470\">transform into participation alimony once the divorce decision becomes final<\/strong>. This type of alimony constitutes a legal arrangement that focuses on <strong data-start=\"383\" data-end=\"422\">the rights and welfare of the child<\/strong>, regardless of the personal relationship between the parents.<\/p>\n<p data-start=\"486\" data-end=\"938\"><strong>Under the <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Turkish Civil Code<\/span><\/span>, the<\/strong> <strong data-start=\"539\" data-end=\"642\">right to claim child support in Turkey generally belongs to the parent who holds custody of the child<\/strong>. The custodial parent may request participation alimony from the <strong data-start=\"708\" data-end=\"732\">non-custodial parent<\/strong> in proportion to their financial capacity, in order to contribute to the child\u2019s expenses. In such cases, the person who holds custody may bring a claim for child support in Turkey. Existence of Divorce or Separation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"548\" data-end=\"946\"><strong>Participation alimony in Turkey arises in cases of divorce or separation<\/strong>. During a divorce proceeding, or upon the occurrence of a separation, the court determines <strong data-start=\"706\" data-end=\"746\">which parent will be granted custody<\/strong> and the <strong data-start=\"755\" data-end=\"812\">obligation of the non-custodial parent to pay alimony<\/strong>. Temporary alimony ordered during the divorce proceedings may <strong data-start=\"875\" data-end=\"945\">convert into participation alimony once the decision becomes final in Turkey<\/strong>.<\/p>\n<h3 data-section-id=\"hv8oar\" data-start=\"948\" data-end=\"992\"><span class=\"ez-toc-section\" id=\"2_The_Childs_Need_for_Care_and_Support\"><\/span>2.
