Within this framework, the <strong data-start=\"760\" data-end=\"801\">general grounds for divorce in Turkey<\/strong> aim to provide a <strong data-start=\"819\" data-end=\"909\">flexible structure that considers the personal and family circumstances of the parties<\/strong>, while also seeking to <strong data-start=\"933\" data-end=\"1026\">balance the protection of the institution of marriage with individual rights and freedoms<\/strong>.<\/p>\n<h3 data-start=\"1034\" data-end=\"1112\"><span class=\"ez-toc-section\" id=\"1-_Breakdown_of_the_Marital_Union_Irretrievable_Breakdown_of_Marriage\"><\/span><strong data-start=\"1037\" data-end=\"1112\">1- Breakdown of the Marital Union (Irretrievable Breakdown of Marriage)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"1114\" data-end=\"1388\">In order to rely on this <strong data-start=\"1139\" data-end=\"1225\">general ground for divorce <\/strong>regulated under Article 166\/1 of the Turkish Civil Code, <strong>the marital union must have fundamentally collapsed<\/strong>, and <strong>the<\/strong> <strong data-start=\"1292\" data-end=\"1387\">continuation of the shared life must have become unbearable for at least one of the spouses<\/strong>.<\/p>\n<p data-start=\"1390\" data-end=\"1478\">The <strong data-start=\"1394\" data-end=\"1444\">elements that must be taken into consideration<\/strong> within this scope are as follows:<\/p>\n<ul>\n<li data-start=\"1482\" data-end=\"1581\">The existence of <strong data-start=\"1499\" data-end=\"1578\">concrete facts proving that the marital union has fundamentally broken down<\/strong>,<\/li>\n<li data-start=\"1584\" data-end=\"1688\">The continuation of the shared life must have become <strong data-start=\"1637\" data-end=\"1685\">unbearably difficult for the claimant spouse<\/strong>,<\/li>\n<li data-start=\"1691\" data-end=\"1864\">The absence of an objection by the defendant claiming that they are <strong data-start=\"1759\" data-end=\"1778\">\u201cless at fault\u201d<\/strong>, or even if such an objection exists, that it has <strong data-start=\"1829\" data-end=\"1863\">not been accepted by the court<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"1866\" data-end=\"1988\">This ground for divorce is accepted in practice as the <strong data-start=\"1921\" data-end=\"1987\">most broadly and frequently applied general ground for divorce<\/strong>.<\/p>\n<h3 data-start=\"1995\" data-end=\"2044\"><span class=\"ez-toc-section\" id=\"2-_Failure_to_Re-Establish_the_Common_Life\"><\/span><strong data-start=\"1998\" data-end=\"2044\">2- Failure to Re-Establish the Common Life<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"2046\" data-end=\"2207\">Pursuant to <strong data-start=\"2058\" data-end=\"2101\">Article 166\/4 of the Turkish Civil Code<\/strong>, the following <strong data-start=\"2117\" data-end=\"2162\">conditions must be fulfilled cumulatively<\/strong> in order to rely on this ground for divorce in Turkey:<\/p>\n<ul>\n<li data-start=\"2211\" data-end=\"2288\">A <strong data-start=\"2213\" data-end=\"2285\">previous divorce lawsuit filed on any ground must have been rejected<\/strong>,<\/li>\n<li data-start=\"2291\" data-end=\"2381\"><strong data-start=\"2291\" data-end=\"2324\">Three years must have elapsed<\/strong> from the date the rejection decision became <strong data-start=\"2369\" data-end=\"2378\">final<\/strong>,<\/li>\n<li data-start=\"2384\" data-end=\"2506\">During this three-year period, the <strong data-start=\"2419\" data-end=\"2503\">common life must not have been re-established between the spouses for any reason<\/strong>,<\/li>\n<li data-start=\"2509\" data-end=\"2591\"><strong data-start=\"2509\" data-end=\"2590\">One of the spouses must have filed a new divorce lawsuit based on this ground<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"2593\" data-end=\"2775\">If these conditions are met, <strong>the<\/strong> <strong data-start=\"2626\" data-end=\"2774\">failure to re-establish the marital union constitutes a conclusive legal presumption <\/strong>that the continuation of the marriage has become impossible.<\/p>\n<h3 data-start=\"2782\" data-end=\"2856\"><span class=\"ez-toc-section\" id=\"3-_Mutual_Agreement_of_the_Spouses_on_Divorce_Uncontested_Divorce\"><\/span><strong data-start=\"2785\" data-end=\"2856\">3- Mutual Agreement of the Spouses on Divorce (Uncontested Divorce)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"2858\" data-end=\"3078\"><strong data-start=\"2858\" data-end=\"2901\">Article 166\/3 of the Turkish Civil Code<\/strong> regulates the type of divorce known in practice as <strong data-start=\"2953\" data-end=\"2987\">uncontested (amicable) divorce<\/strong>. Whether the act was <strong data-start=\"1605\" data-end=\"1691\">planned or committed in a moment of sudden anger does not change the legal outcome<\/strong>. <strong data-start=\"1693\" data-end=\"1712\">Cruel treatment<\/strong> includes acts such as <strong data-start=\"1735\" data-end=\"1766\">physical or sexual violence<\/strong>, <strong data-start=\"1768\" data-end=\"1799\">assault on bodily integrity<\/strong>, or other <strong data-start=\"1810\" data-end=\"1834\">serious acts of harm<\/strong>. <strong data-start=\"1836\" data-end=\"1857\">Degrading conduct<\/strong> includes actions that <strong data-start=\"1880\" data-end=\"1969\">violate the personal honor of the spouse through verbal, written, or physical attacks<\/strong>.<\/p>\n<p data-start=\"1972\" data-end=\"2177\">For these grounds, a forfeiture period also applies:<strong> the<\/strong> <strong data-start=\"2033\" data-end=\"2109\">lawsuit must be filed within 6 months from the date the cause is learned<\/strong>, and <strong data-start=\"2115\" data-end=\"2176\">in any case within 5 years from the date the act occurred<\/strong>.<\/p>\n<h3 data-start=\"2184\" data-end=\"2247\"><span class=\"ez-toc-section\" id=\"3_Commission_of_a_Crime_and_Leading_a_Dishonorable_Life\"><\/span><strong data-start=\"2187\" data-end=\"2247\">3. In such cases, no forfeiture period is prescribed, meaning that <strong data-start=\"2738\" data-end=\"2807\">the right to file a lawsuit is not subject to any time limitation<\/strong>.<\/p>\n<h3 data-start=\"2815\" data-end=\"2848\"><span class=\"ez-toc-section\" id=\"4_Abandonment_Desertion\"><\/span><strong data-start=\"2818\" data-end=\"2848\">4. Abandonment (Desertion)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"2850\" data-end=\"3310\">Under Article 164 of the Turkish Civil Code, if <strong data-start=\"2902\" data-end=\"2954\">one of the spouses abandons the common residence<\/strong>, and this abandonment <strong data-start=\"2977\" data-end=\"3012\">continues for at least 6 months<\/strong>, and if the <strong data-start=\"3025\" data-end=\"3089\">abandoning spouse does not return despite a judicial warning<\/strong>, a <strong data-start=\"3093\" data-end=\"3125\">divorce lawsuit may be filed<\/strong>.
