institutions, bringing individuals together on the basis of <strong>love, trust, and respect<\/strong>, and enabling them to live in <strong>peace and solidarity<\/strong>. Unfortunately, in some cases, incidents of <strong>physical, psychological, sexual, economic and domestic violence<\/strong> may occur within the family. <strong>Domestic violence<\/strong> is a serious issue that negatively affects not only the victim\u2019s <strong>physical integrity<\/strong> but also their <strong>mental health, social life, and economic independence<\/strong>.<\/p>\n<p>Within the framework of <a href=\"https:\/\/www.cbhukuk.com\/en\/practice-areas\/family-law\/\"><strong>Turkish Family Law<\/strong><\/a>, various legal regulations have been enacted to <strong>prevent domestic violence<\/strong> and <strong>protect victims of violence<\/strong>. In particular, <strong>Law No. 6284 on the Protection of the Family and the Prevention of Violence Against Women<\/strong> provides for <strong>protective and preventive measures<\/strong> aimed at safeguarding individuals who have been subjected to violence or are at risk of violence. <strong>Restraining orders<\/strong> and <strong>protective measures<\/strong> issued under this law play a significant role in ensuring the <strong>safety and security of victims<\/strong>.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"WHAT_IS_DOMESTIC_VIOLENCE\"><\/span>WHAT IS DOMESTIC VIOLENCE?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"isSelectedEnd\"><strong>Domestic violence<\/strong> refers to any form of <strong>physical, psychological, sexual, verbal, or economic abuse<\/strong> occurring between <strong>spouses, former spouses, fianc\u00e9s, family members, or individuals living in the same household<\/strong>. The existence of domestic violence does not necessarily require a physical assault. Continuous <strong><a href=\"https:\/\/www.cbhukuk.com\/en\/insult-crime-in-turkey\/\">insults<\/a>, threats, coercive control, deprivation of financial resources, social isolation<\/strong>, or <strong>qualified economic deception amounting to <a href=\"https:\/\/www.cbhukuk.com\/en\/fraud-crime-in-turkey\/\">fraud<\/a> through the abuse of trust between spouses regarding each other\u2019s assets<\/strong> may also be considered forms of domestic violence.<\/p>\n<p class=\"isSelectedEnd\">The most common forms of domestic violence include:<\/p>\n<ul data-spread=\"false\">\n<li><strong>Physical violence<\/strong><\/li>\n<li><strong>Psychological or emotional violence<\/strong><\/li>\n<li><strong>Sexual violence<\/strong><\/li>\n<li><strong>Economic violence<\/strong><\/li>\n<li><strong>Harassment and stalking carried out through digital means and communication technologies<\/strong><\/li>\n<\/ul>\n<p>The <strong>Turkish legal system<\/strong> regards domestic violence as a <strong>serious violation of fundamental rights and freedoms<\/strong> and provides <strong>effective legal mechanisms<\/strong> for the <strong>protection of victims<\/strong>.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"METHODS_OF_PROTECTION_AGAINST_DOMESTIC_VIOLENCE_AND_LEGAL_MEASURES_IN_TURKEY\"><\/span>METHODS OF PROTECTION AGAINST DOMESTIC VIOLENCE AND LEGAL MEASURES IN TURKEY<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p class=\"isSelectedEnd\">In Turkey, various <strong>legal measures<\/strong> may be implemented to <strong>protect victims of domestic violence<\/strong> and <strong>prevent further abuse<\/strong>. Individuals who have been subjected to violence or are under the threat of violence may apply to <strong>law enforcement authorities, the Public Prosecutor\u2019s Office, or the Family Courts<\/strong> to request protection.<\/p>\n<p class=\"isSelectedEnd\"><strong>The main legal measures available in Turkey include:<\/strong><\/p>\n<ul>\n<li><strong>Protection and Restraining Orders: <\/strong>Courts may issue orders prohibiting the perpetrator from approaching the victim, the <strong>shared residence<\/strong>, the victim\u2019s <strong>workplace<\/strong>, or the <strong>educational institutions attended by the children<\/strong>. The perpetrator may also be prohibited from contacting the victim through <strong>telephone calls, text messages, emails, or social media platforms<\/strong>.<\/li>\n<li><strong>Emergency Protection Measures: <\/strong>In urgent situations, <strong>law enforcement authorities<\/strong> may provide immediate protection, and where necessary, <strong>temporary protective measures<\/strong> may be implemented without delay.<\/li>\n<li><strong>Criminal Complaints and Criminal Investigations: <\/strong>Where acts of violence constitute a criminal offense, the victim may file a <strong>criminal complaint with the Public Prosecutor\u2019s Office in Turkey<\/strong>. <a href=\"https:\/\/www.cbhukuk.com\/en\/practice-areas\/file-a-lawsuit-in-turkey\/\"><strong>Legal proceedings<\/strong><\/a> initiated in response to such violations may result in the filing of <strong>criminal charges<\/strong> against the perpetrator.<\/li>\n<li><strong>Shelter and Support Services: <\/strong>Victims of domestic violence may receive <strong>temporary accommodation, psychological support, social assistance, and legal counseling services<\/strong> through governmental institutions and other relevant organizations in Turkey.<\/li>\n<li><strong>Divorce and Child Custody Proceedings: <\/strong><strong>Domestic violence<\/strong> may constitute a significant legal ground for divorce under Turkish law. Within the scope of the Law, the following objectives are particularly pursued:<\/p>\n<ol data-spread=\"false\">\n<li><strong>Prevention of Violence:<\/strong> Taking preventive measures to stop the occurrence of <strong>domestic violence and violence against women in Turkey<\/strong>.<\/li>\n<li><strong>Protection of Victims:<\/strong> Ensuring the <strong>safety and security of individuals exposed to violence<\/strong> and implementing necessary <strong>protective measures in Turkey<\/strong>.<\/li>\n<li><strong>Provision of Legal and Institutional Support:<\/strong> Facilitating victims\u2019 access to their <strong>legal rights<\/strong> and ensuring they benefit from available <strong>support mechanisms<\/strong>.<\/li>\n<li><strong>Psychological and Social Support:<\/strong> Providing <strong>psychological, social, and economic support<\/strong> to victims and helping them rebuild a <strong>safe and stable life<\/strong>.<\/li>\n<\/ol>\n<ul>\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Importance_Of_Law_No_6284_On_The_Protection_Of_The_Family_And_The_Prevention_Of_Violence_Against_Women\"><\/span>Importance Of Law No. 6284 On The Protection Of The Family And The Prevention Of Violence Against Women<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p><strong>Law No. 6284 is one of the fundamental legal bases in Turkey for combating<\/strong> <strong>domestic violence and violence against women<\/strong>. Thanks to this Law, victims can quickly request <strong>protective measures<\/strong>, obtain <strong>restraining orders<\/strong>, and benefit from various <strong>social support mechanisms in Turkey<\/strong>.<\/p>\n<p>However, it should be noted that the effectiveness of the Law is not limited to legal regulations alone; it also depends on <strong>raising public awareness<\/strong>, <strong>coordinated action among public institutions<\/strong>, and the <strong>effective implementation of protective measures<\/strong>.<\/p>\n<ul>\n<li>\n<h3><span class=\"ez-toc-section\" id=\"The_Scope_of_Law_No_6284_on_the_Protection_of_the_Family_and_the_Prevention_of_Violence_Against_Women\"><\/span>The Scope of Law No. 6284 on the Protection of the Family and the Prevention of Violence Against Women<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">Under the Law, various <strong>protective and preventive measures<\/strong> may be ordered by <strong>judges, administrative authorities, or law enforcement officers<\/strong> in urgent situations where <strong>delay would be detrimental<\/strong>.<\/p>\n<p class=\"isSelectedEnd\"><strong>The most common of these are as follows:<\/strong><\/p>\n<ol>\n<li class=\"isSelectedEnd\"><strong>Restraining Order:<\/strong> The perpetrator may be ordered to <strong>leave the shared residence<\/strong>, to <strong>refrain from approaching the victim<\/strong>, and to stay away from <strong>designated areas<\/strong>. Restraining orders are one of the most frequently applied <strong>protective measures in domestic violence cases in Turkey<\/strong>.<\/li>\n<li class=\"isSelectedEnd\"><strong>Contact Prohibition:<\/strong> The perpetrator may be prohibited from <strong>harassing or contacting the victim<\/strong> via <strong>telephone, text messages, e-mail, social media, or other communication tools<\/strong>.<\/li>\n<li class=\"isSelectedEnd\"><strong>Protection and Security Measures:<\/strong> Where necessary, <strong>temporary protection<\/strong> may be provided to the victim, <strong>identity and address information may be kept confidential<\/strong>, or the victim may be placed in a <strong>safe location<\/strong>. At this point, the <strong>security of the victim\u2019s personal data<\/strong> is strictly protected in line with <a href=\"https:\/\/www.cbhukuk.com\/en\/practice-areas\/data-protection-in-turkey\/\"><strong>data protection and confidentiality principles in Turkey<\/strong><\/a>.<\/li>\n<li class=\"isSelectedEnd\"><strong>Shelter and Social Support Services:<\/strong> To ensure the safety of victims of violence, <strong>shelter and counseling services<\/strong> may be provided through <strong>women\u2019s shelters, Violence Prevention and Monitoring Centers (\u015e\u00d6N\u0130M), and other social support mechanisms<\/strong>.<\/li>\n<li class=\"isSelectedEnd\"><strong>Temporary Financial Assistance and Other Support:<\/strong> Within the scope of the Law, it is possible to provide <strong>temporary financial assistance<\/strong>, <strong>healthcare support<\/strong>, and access to <strong>social services<\/strong> for those in need. If such financial assistance or <strong>court-ordered maintenance payments<\/strong> are not made voluntarily, <a href=\"https:\/\/www.cbhukuk.com\/en\/practice-areas\/debt-enforcement-in-turkey\/\"><strong>enforcement proceedings under enforcement and bankruptcy law<\/strong><\/a> may be initiated to collect the receivables.<\/li>\n<\/ol>\n<ul>\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Consequences_of_Non-Compliance_with_Protective_Measures_in_Turkey\"><\/span>Consequences of Non-Compliance with Protective Measures in Turkey<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">If a <strong>restraining order or other protective measures<\/strong> issued under Law No. 6284 are violated, the perpetrator may be subjected to <strong>coercive imprisonment in Turkey<\/strong>. The <strong>victim\u2019s statement and the circumstances of the incident<\/strong> are generally sufficient for the issuance of protective measures.<\/p>\n<ul>\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Importance_of_Protection_Orders_in_Domestic_Violence_Cases\"><\/span>Importance of Protection Orders in Domestic Violence Cases<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p class=\"isSelectedEnd\">A protection order is one of the most <strong>effective legal instruments<\/strong> for ensuring the safety of victims of domestic violence.
