class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><strong>The rent for a residential property<\/strong> is determined by <strong><a href=\"https:\/\/www.cbhukuk.com\/en\/practice-areas\/contract-law-in-turkey\/\">the agreement<\/a><\/strong> between the landlord and the tenant, and this agreement provides for <strong>an arrangement regarding rent increases.<\/strong> Although the law and other legal regulations set a <strong>maximum rate for rent increases in Turkey<\/strong> by the state, landlords are demanding <strong>exorbitant rent increases<\/strong> from their tenants today due to high inflation. This situation creates financial difficulties for tenants, <strong>who are forced to endure rack rent in Turkey.<\/strong> Rack rent is a significant problem for tenants, and it is possible to find a solution to this problem through legal means.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"IS_IT_POSSIBLE_TO_INCREASE_RENT_IN_TURKEY_MORE_THAN_THE_CPI_TUFE_RATE\"><\/span>IS IT POSSIBLE TO INCREASE RENT IN TURKEY MORE THAN THE CPI (T\u00dcFE) RATE?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>An exorbitant rent increase<\/strong> is when the current rent is raised to an <strong>unreasonably high level<\/strong> compared to market conditions. This situation usually arises when the landlord <strong>increases the rent amount<\/strong> when renewing the tenant&#8217;s contract.<\/p>\n<p>In Turkey, before making a rent increase, landlords should consider <strong>the 12-month average Consumer Price Index (T\u00dcFE) rate<\/strong> <strong>announced by the Turkish Statistical Institute (T\u00dc\u0130K).<\/strong> Increasing the rent by the T\u00dcFE rate is the landlord&#8217;s legal right in Turkey. However, if the landlord wants to <strong>increase the rent by more than the T\u00dcFE rate<\/strong>, the tenant is not obliged to accept this <strong>high rent increase in Turkey.<\/strong> Since <strong>T\u00dcFE rate is upper limit for rent increase in Turkey<\/strong>, an increase in rent above the T\u00dcFE rate is only valid with the tenant&#8217;s consent.<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_small\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_grid cols_1 laptops-cols_inherit tablets-cols_inherit mobiles-cols_1 valign_top type_default stacking_default\"><div class=\"wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"w-iconbox us_custom_aea21514 iconpos_left style_default color_secondary align_center no_title\"><div class=\"w-iconbox-icon\" style=\"font-size:2rem;\"><i class=\"fas fa-gavel\"><\/i><\/div><div class=\"w-iconbox-meta\"><div class=\"w-iconbox-text\"><p><a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.6098.pdf\" target=\"_blank\" rel=\"noopener\"><strong>Article 344 of the Turkish Code of Obligations<\/strong><\/a> &#8211; Agreements regarding the rental fee to be applied in renewed rental periods are valid, provided that they do not exceed the rate of change in the twelve-month average of the consumer price index in the previous rental year. This rule also applies to rental agreements lasting more than one year.<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_auto\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_grid cols_1 laptops-cols_inherit tablets-cols_inherit mobiles-cols_1 valign_top type_default stacking_default\"><div class=\"wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_text_column us_custom_275474cc has_text_color\"><div class=\"wpb_wrapper\"><h2><span class=\"ez-toc-section\" id=\"THE_EXPIRATION_OF_THE_TEMPORARY_REGULATION_LIMITING_HOUSING_RENT_INCREASES_TO_25\"><\/span>THE EXPIRATION OF THE TEMPORARY REGULATION LIMITING HOUSING RENT INCREASES TO 25%<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>The price increases applied to rental housing in Turkey<\/strong> have reached quite high levels, especially in recent years. This situation has created a serious <strong>financial burden for tenants<\/strong>, leading to the idea that <strong>rent increase rate in Turkey<\/strong> <strong>should be limited.<\/strong> Therefore, it was decided to temporarily <strong>upper limit for rent increases to 25% in Turkey for residential properties.<\/strong> This regulation introduced a <strong>temporary limitation in residential lease agreements<\/strong> under the Turkish Code of Obligations No. 6098. Pursuant to the provisions of Provisional Article 2, <strong>the 25% rent increase cap ended on July 1, 2024.<\/strong><\/p>\n<p><strong>According to this regulation, the rent increase rate in Turkey for residential rents is limited to a maximum of 25%.<\/strong> In this context, demanding an increase of more than <strong>25% in rent until July 1, 2024<\/strong>, is not legally required to be accepted by the tenant. This measure aims to prevent tenants from being victimized. However, <strong>limiting rent increase rate in Turkey<\/strong> has also brought about some drawbacks.<\/p>\n<p>Firstly, <strong>the limitation of rent increases in Turkey<\/strong> has resulted in a decrease in landlords&#8217; income. Therefore, <strong>landlords have tended <a href=\"https:\/\/www.cbhukuk.com\/en\/tenants-rights-when-landlord-sold-property\/\">to sell rented properties<\/a><\/strong> instead of increasing rental prices. This situation has created a supply-demand imbalance in the housing market.<\/p>\n<p>Another negative impact is <strong>the reduction in the supply of rental housing.<\/strong> Landlords being capped at a rent price that tenants can pay may lead to a decrease in the supply of rental housing. In this case, it may become even more difficult for tenants<strong> to find affordable rental housing.<\/strong><\/p>\n<p>As a result, although <strong>the temporary regulation limiting rent increases to 25% in Turkey<\/strong> was intended to protect tenants, it also brought some <strong>negative consequences<\/strong> and became one of the factors contributing to uncontrolled inflation. <strong>The regulation limiting rent increases to 25% ended on July 1, 2024. If the change rate according to the twelve-month averages of the consumer price index of the previous rental year is below twenty-five percent, the change rate will be valid. This rule also applies to rental agreements longer than one year. Agreements made in excess of these rates will be invalid for the excess amount. If the tenant fails to make the payment after this notice, <strong>the landlord can initiate enforcement proceedings and proceed with <a href=\"https:\/\/www.cbhukuk.com\/en\/tenant-eviction-process-in-turkey\/\">the eviction process in Turkey<\/a>.<\/strong><\/p>\n<p class=\"\" data-start=\"1118\" data-end=\"1473\">However, if the <strong data-start=\"1134\" data-end=\"1185\">landlord demands a high rent increase in Turkey<\/strong> that exceeds the legal limits, the tenant is <strong data-start=\"1231\" data-end=\"1258\">not obligated to accept<\/strong> the unlawful rent increase. <strong>The tenant&#8217;s refusal to pay the excessive rent does not constitute a valid reason for eviction.<\/strong> Therefore, a tenant cannot be evicted simply for not accepting <strong>an excessive rent increase in Turkey.<\/strong><\/p>\n<p class=\"\" data-start=\"1475\" data-end=\"1652\">A landlord can only <strong>evict a tenant in Turkey<\/strong> based on certain legal grounds.
