possession without any conditions. <strong>Various reasons may lead to the rejection of inheritance, including excessive debts, low value of the inheritance, or the intention to protect the rights of other heirs.<\/strong><\/p>\n<p data-start=\"505\" data-end=\"1120\"><strong>No one can<\/strong> <strong>be forced to accept an inheritance in Turkey.<\/strong> Upon the opening of the inheritance, the estate, including its assets and liabilities, <strong>automatically transfers to the heirs<\/strong> under <strong><a href=\"https:\/\/www.cbhukuk.com\/en\/practice-areas\/inheritance-law-in-turkey\/\">Turkish Inheritance Law<\/a>.<\/strong> However, the legislator has also granted heirs the right to refuse their status as heirs. By <strong>rejecting the inheritance in Turkey<\/strong>, heirs can avoid being held responsible for the deceased\u2019s debts. Additionally, in some cases, <strong>heirs may choose to disclaim the inheritance<\/strong> <strong>to safeguard the rights of other heirs<\/strong>, as accepting an inheritance may impose certain obligations on them regarding the distribution of shares among other heirs.<\/p>\n<p data-start=\"1122\" data-end=\"1488\"><strong>If a person decides to refuse an inheritance in Turkey, they will not receive any rights or shares from the deceased\u2019s assets.<\/strong> However, by rejecting the inheritance in Turkey, the individual also <strong>avoids taking on the deceased\u2019s debts<\/strong>, thereby preserving their own assets. <strong>Nevertheless, an heir who disclaim the inheritance in Turkey cannot benefit from any receivables the deceased may have had.<\/strong><\/p>\n<p data-start=\"1490\" data-end=\"1919\" data-is-last-node=\"\" data-is-only-node=\"\"><strong>The process of disclaimer of inheritance in Turkey begins after the death of the deceased.<\/strong> When heirs enter the legal process of distributing the deceased\u2019s assets, an heir who does not wish to accept the inheritance can exercise their right <strong>by submitting a declaration of renunciation<\/strong>. A rejection based on the heir&#8217;s own will is called an <strong>&#8220;voluntary rejection,&#8221;<\/strong> whereas a rejection presumed by law is referred to as a <strong>&#8220;statutory (legal) rejection.&#8221;<\/strong><\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_small\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_grid cols_1 laptops-cols_inherit tablets-cols_inherit mobiles-cols_1 valign_top type_default stacking_default\"><div class=\"wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"w-iconbox us_custom_aea21514 iconpos_left style_default color_secondary align_center no_title\"><div class=\"w-iconbox-icon\" style=\"font-size:2rem;\"><i class=\"fas fa-gavel\"><\/i><\/div><div class=\"w-iconbox-meta\"><div class=\"w-iconbox-text\"><p>Article 609 of the <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.4721.pdf\" target=\"_blank\" rel=\"noopener\">Turkish Civil Code<\/a> &#8211; The rejection of inheritance is made by the heirs through an oral or written statement to the reconciliation court. The rejection must be unconditional.
