process, divorce has also become an ordinary aspect of life.<\/strong> This reality has led many couples in Turkey to seek protection of their rights through <strong>a marriage contract in Turkey<\/strong>, especially as divorce has become a widespread sociological phenomenon. During divorce proceedings in Turkey, disputes frequently arise concerning claims for <strong>material and moral compensation, alimony arrangements, and <a href=\"https:\/\/www.cbhukuk.com\/en\/practice-areas\/family-law\/child-custody-in-turkey\/\">child custody<\/a>.<\/strong> Additionally, the division of property acquired during the marriage has emerged as <strong>a significant legal issue under the framework of the dissolution of the marital property regime in Turkey.<\/strong><\/p>\n<p data-start=\"655\" data-end=\"1330\" data-is-last-node=\"\" data-is-only-node=\"\"><strong>A premarital agreement in Turkey is a contract commonly signed by couples who are married or planning to marry.<\/strong> It primarily outlines how the couple\u2019s assets will be divided. In Turkish civil law, such an agreement is referred to as a<strong> \u201cproperty regime contract\u201d<\/strong>. It is used to resolve current or potential conflicts over asset division. Couples often choose to enter into a legally binding marriage contract <strong>to avoid the emotionally and financially exhausting outcomes of divorce litigation<\/strong> <strong>and to enjoy the peace of mind that comes from making decisions<\/strong> about their future independently of events that may occur during the course of the marriage.<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_small\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_grid cols_1 laptops-cols_inherit tablets-cols_inherit mobiles-cols_1 valign_top type_default stacking_default\"><div class=\"wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"w-iconbox us_custom_aea21514 iconpos_left style_default color_secondary align_center no_title\"><div class=\"w-iconbox-icon\" style=\"font-size:2rem;\"><i class=\"fas fa-gavel\"><\/i><\/div><div class=\"w-iconbox-meta\"><div class=\"w-iconbox-text\"><p><a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuatmetin\/1.5.4721.pdf\" target=\"_blank\" rel=\"noopener\"><strong>TURKISH CIVIL CODE<\/strong><\/a> Article 203 &#8211; A matrimonial property regime contract can be made before or after marriage. The parties may choose, abolish, or amend the property regime they desire only within the limits prescribed by law.<\/p>\n<p>Article 205 &#8211; A matrimonial property regime contract is made in the form of drafting or certifying at a notary. However, the parties may also communicate in writing which property regime they have chosen during the application for marriage.<\/p>\n<p>It is mandatory for the parties to sign the matrimonial property regime contract, and if necessary, it must also be signed by their legal representatives.<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_auto\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_grid cols_1 laptops-cols_inherit tablets-cols_inherit mobiles-cols_1 valign_top type_default stacking_default\"><div class=\"wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_text_column us_custom_275474cc has_text_color\"><div class=\"wpb_wrapper\"><h2><span class=\"ez-toc-section\" id=\"THE_LEGAL_CONCEPT_OF_PROPERTY_REGIMES_IN_TURKEY\"><\/span>THE LEGAL CONCEPT OF PROPERTY REGIMES IN TURKEY<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>The set of rules that regulate the rights and obligations of spouses over their respective assets before or during the continuation of marriage, as well as the disposal of these assets in the event of divorce, is referred to as the &#8220;property regime&#8221;.<\/strong> Additionally, legal procedures are carried out to select and\/or modify the applicable property regime<strong> through marriage agreements in Turkey.<\/strong> However, it is important to note that <strong>marriage contract in Turkey is<\/strong> <strong>not a commitment to each other&#8217;s behavior;<\/strong> it is a contract made to regulate property.<\/p>\n<p><strong>These contracts, which are referred to colloquially as &#8220;marriage agreements&#8221; have a legal equivalent called &#8220;property regime contracts&#8221; in the Turkish law.<\/strong> Before answering the question of what is premarital agreement in Turkey is,<strong> it is important to have a good understanding of the concept of property regime and the types of property regimes specified in the law<\/strong>. The legislator has introduced four different property regimes in Turkey.<strong> The types of property regimes specified in the law are as follows:<\/strong><\/p>\n<ul>\n<li data-start=\"0\" data-end=\"507\">\n<h3><span class=\"ez-toc-section\" id=\"Participation_in_Acquired_Property_Regime_in_Turkey\"><\/span><strong data-start=\"0\" data-end=\"46\">Participation in Acquired Property Regime in Turkey:<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p data-start=\"0\" data-end=\"507\"><strong>This is the default property regime recognized under the Turkish Civil Code.<\/strong> In other words, if spouses do not establish a marital property regime through a marriage contract in Turkey,<strong> the legal regime of participation in acquired property automatically applies.<\/strong> Under this regime, all assets acquired after the marriage are considered jointly owned, regardless of the spouses\u2019 individual contributions, <strong>and are divided equally during <a href=\"https:\/\/www.cbhukuk.com\/en\/guide-to-divorce-in-turkey\/\">divorce proceedings in Turkey<\/a>.<\/strong><\/p>\n<ul>\n<li data-start=\"509\" data-end=\"1096\">\n<h3><span class=\"ez-toc-section\" id=\"Separation_of_Property_Regime_in_Turkey\"><\/span><strong data-start=\"509\" data-end=\"543\">Separation of Property Regime in Turkey:<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p data-start=\"509\" data-end=\"1096\"><strong>In the separation of property regime in Turkey, each spouse retains the right to manage, benefit from, and dispose of their own assets within legal boundaries.<\/strong> In other words, each spouse remains the sole owner of their assets even after divorce.
