This type of lawsuit is one of <strong>the fundamental elements of the job security system<\/strong> under Turkish labor law. Its purpose is to protect employees from <strong data-start=\"409\" data-end=\"443\">unjust or unlawful termination in Turkey<\/strong>, while also ensuring <strong data-start=\"465\" data-end=\"517\">compensation for the financial and moral damages<\/strong> suffered as a result of the termination process.<\/p>\n<p data-start=\"570\" data-end=\"1209\">Regulated under <strong data-start=\"586\" data-end=\"642\">Articles 18 to 21 of the Turkish Labor Code No. 4857<\/strong>, the action for reinstatement in Turkey clearly sets out the employer\u2019s obligation to base <strong>the termination of an employment contract on the<\/strong> <strong data-start=\"770\" data-end=\"799\">principle of valid reason<\/strong>. For instance, <strong data-start=\"1333\" data-end=\"1357\">poor job performance<\/strong> or <strong data-start=\"1361\" data-end=\"1406\">economic downturns affecting the business<\/strong> may constitute valid reasons for termination in Turkey, whereas dismissals based on <strong data-start=\"1481\" data-end=\"1541\">union activities, gender, pregnancy, or personal beliefs<\/strong> are not considered lawful. <strong>Such grounds for termination in Turkey are<\/strong> <strong data-start=\"1602\" data-end=\"1655\">in direct violation of the job security principle<\/strong>.<\/p>\n<p data-start=\"1660\" data-end=\"2166\" data-is-last-node=\"\" data-is-only-node=\"\"><strong>In conclusion, a reinstatement lawsuit in Turkey provides employees with<\/strong> <strong data-start=\"1723\" data-end=\"1779\">effective legal protection against unfair dismissals<\/strong>. Through this legal process, the employee may not only regain their <strong data-start=\"1848\" data-end=\"1869\">previous position<\/strong> but also claim <strong data-start=\"1885\" data-end=\"1938\">compensation for wages and other financial losses<\/strong> incurred during the period of unemployment. If the parties reach an agreement, the dispute may, within the same period, be submitted to a <strong data-start=\"735\" data-end=\"757\">private arbitrator<\/strong> instead of the labor court.<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_auto\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_grid cols_1 laptops-cols_inherit tablets-cols_inherit mobiles-cols_1 valign_top type_default stacking_default\"><div class=\"wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_text_column us_custom_275474cc has_text_color\"><div class=\"wpb_wrapper\"><h2><span class=\"ez-toc-section\" id=\"WHAT_ARE_THE_CONDITIONS_FOR_FILING_A_REINSTATEMENT_LAWSUIT_IN_TURKEY\"><\/span><strong>WHAT ARE THE CONDITIONS FOR FILING A REINSTATEMENT LAWSUIT IN TURKEY?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>A reinstatement lawsuit in Turkey<\/strong> is a legal remedy that enables an employee to benefit from <strong>job security protection<\/strong> and to seek <strong>reinstatement<\/strong> in cases of <strong>unlawful termination in Turkey<\/strong>. In order to file such a lawsuit, certain <strong>preconditions defined under Turkish labor law must be met<\/strong>. The main conditions for <strong>filing a reinstatement lawsuit in Turkey<\/strong> are explained in detail below.<\/p>\n<ol>\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Being_Subject_to_the_Labor_Law_or_the_Press_Labor_Law\"><\/span><strong> Being Subject to the Labor Law or the Press Labor Law<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ol>\n<p>To file a reinstatement lawsuit in Turkey, the employee must be working under the scope of the <strong>Turkish Labor Code No. 4857<\/strong> or the <strong>Press Labor Law No. 5953<\/strong>. Employees working under other regulations\u2014such as <a href=\"https:\/\/www.cbhukuk.com\/en\/maritime-labor-law-in-turkey\/\"><strong>Maritime Labor Law<\/strong><\/a>, <a href=\"https:\/\/www.cbhukuk.com\/en\/collection-of-footballers-debts\/\"><strong>Sports Law<\/strong><\/a>, or the <strong>Turkish Code of Obligations<\/strong>\u2014<strong>are not entitled<\/strong> to file a reinstatement claim in Turkey under the job security provisions.<\/p>\n<p>In addition, the <strong>exceptions listed in Article 4 of the Labor Code<\/strong> are <strong>excluded<\/strong> from the scope of job security. <strong>Accordingly, contracted personnel, apprentices, and interns are not eligible to request reinstatement claim in Turkey.<\/strong><\/p>\n<ol start=\"2\">\n<li>\n<h3><span class=\"ez-toc-section\" id=\"The_Employer_Must_Employ_a_Minimum_Number_of_Workers\"><\/span><strong> The Employer Must Employ a Minimum Number of Workers<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ol>\n<p><strong>In order to file a reinstatement lawsuit in Turkey, the workplace must employ at least 30 workers on the date of termination.<\/strong> However, in <strong>agriculture and forestry sectors<\/strong>, the minimum requirement is <strong>51 employees<\/strong>.<\/p>\n<p>If the employer operates <strong>multiple workplaces within the same line of business<\/strong>, the total number of employees is <strong>calculated across all workplaces<\/strong>. <strong>This regulation allows employers in Turkey to combine their workforce across workplaces to meet the 30-worker criterion.<\/strong><\/p>\n<p>Certain categories of workers are <strong>not counted<\/strong> in this calculation, including <strong>substitute workers, apprentices, interns, temporary agency workers, and subcontractor employees<\/strong>.<\/p>\n<p>These two fundamental requirements are <strong>crucial for the legal validity<\/strong> of the reinstatement lawsuit in Turkey and the <strong>functioning of the job security system<\/strong>. Meeting these criteria grants the employee the <strong>right to challenge the unlawful termination in Turkey<\/strong> and obtain <strong>effective legal protection<\/strong> <strong>against unfair dismissal in Turkey.<\/strong><\/p>\n<ol start=\"3\">\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Having_at_Least_Six_Months_of_Seniority\"><\/span><strong> Having at Least Six Months of Seniority<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ol>\n<p>To be eligible to file an cction for reinstatement in Turkey, the employee must have <strong>at least six months of seniority<\/strong> in the workplace. This period covers the time from the <strong>commencement of employment<\/strong> until the <strong>notification of termination<\/strong>. The six-month seniority condition is essential for the <strong>applicability of job security<\/strong>, and it applies to nearly all employees, <strong>except for a few special categories.<\/strong><\/p>\n<p>This condition is <strong>relatively mandatory<\/strong>, meaning that it may be <strong>shortened or waived<\/strong> by individual or collective labor agreements, but <strong>cannot be extended to the employee\u2019s detriment<\/strong>.<\/p>\n<p><strong>For underground workers, the six-month requirement does not apply in Turkey.<\/strong> The <strong>probation period<\/strong> is included in the calculation of seniority, whereas the <strong>notice period<\/strong> is not. Additionally, the <strong>periods during which the employee is on sick leave<\/strong> are also included in <a href=\"https:\/\/www.cbhukuk.com\/en\/severance-pay-calculation\/\"><strong>the seniority calculation in Turkey<\/strong><\/a>.<\/p>\n<p><strong>The Court of Cassation has clearly confirmed this principle in its rulings:<\/strong><\/p>\n<p><em>\u201cIt is erroneous to decide on the merits of the case and to accept the reinstatement claim without considering that the plaintiff\u2019s employment duration with the defendant was less than six months, and therefore the mandatory condition of at least six months of seniority was not met.\u201d<\/em><br \/>\n(<strong>Court of Cassation 7th Civil Chamber, 24.12.2015, E. 2015\/31765, K. 2015\/26701<\/strong>)<\/p>\n<p>Regardless of the number of employees in the workplace or the identity of the employer, <strong>union representatives<\/strong> a<strong>re exempt from the six-month seniority requirement in Turkey.<\/strong> Therefore, they may file a reinstatement lawsuit in Turkey <strong>regardless of their length of service<\/strong>.<\/p>\n<ol start=\"4\">\n<li>\n<h3><span class=\"ez-toc-section\" id=\"The_Employment_Contract_Must_Be_Indefinite-Term\"><\/span><strong> The Employment Contract Must Be Indefinite-Term<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ol>\n<p><strong>In order to file a reinstatement lawsuit in Turkey, the employee must be working under an<\/strong> <strong>indefinite-term employment contract<\/strong>. <strong>Fixed-term employment contracts<\/strong> may not be renewed consecutively unless there is a <strong>justifiable reason<\/strong>; otherwise, such contracts are considered <strong>indefinite-term from the beginning<\/strong>. This rule constitutes a <strong>legal prerequisite for the employee\u2019s right to file a reinstatement lawsuit in Turkey.<\/strong><\/p>\n<p>The criterion of an indefinite-term contract is evaluated carefully, particularly in certain sectors in Turkey. For example, <strong>teachers employed by private schools<\/strong> under the <strong>Private Education Institutions Law No. 5580<\/strong> work with <strong>fixed-term contracts<\/strong> as required by the law and therefore <strong>do not have the right to file an action for reinstatement in Turkey.<\/strong><\/p>\n<p>This condition is one of the <strong>fundamental criteria defining the scope<\/strong> of reinstatement lawsuits in Turkey, emphasizing that <strong>job security protection applies only to indefinite-term employment relationships<\/strong>.<\/p>\n<ol start=\"5\">\n<li>\n<h3><span class=\"ez-toc-section\" id=\"The_Employment_Contract_Must_Be_Terminated_by_the_Employer_Without_a_Valid_Reason\"><\/span><strong> The Employment Contract Must Be Terminated by the Employer Without a Valid Reason<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ol>\n<p>To file a reinstatement lawsuit in Turkey, the <strong>termination must be initiated by the employer<\/strong> and must be <strong>without a valid reason<\/strong>. Turkish labor law requires the employer to rely on <strong>justified or valid grounds<\/strong> when terminating an employment contract.<\/p>\n<p><strong>Valid reasons<\/strong> <strong>may include the employee\u2019s poor performance<\/strong>, <strong>misconduct in the workplace<\/strong>,<strong> or<\/strong> <strong>economic and organizational needs<\/strong> <strong>of the enterprise.<\/strong> However, dismissals based on <strong>union membership or activity<\/strong>, <strong>gender<\/strong>, <strong>religion<\/strong>, or <strong>marital status<\/strong> are not considered valid.<\/p>\n<p>If the employment contract is <strong>terminated by mutual agreement<\/strong> or <strong>resignation<\/strong>, the employee cannot file a reinstatement lawsuit in Turkey. However, if the termination is <strong>falsely presented as a mutual termination<\/strong>\u00a0or <strong>resignation<\/strong> to disguise an actual employer-initiated dismissal,<strong> the employee may still seek reinstatement claim in Turkey.<\/strong><\/p>\n<p>Article 18\/3 of the <strong>Labor Code<\/strong> provides examples of <strong>situations that do not constitute valid reasons for termination<\/strong>. Accordingly, the following reasons <strong>cannot justify dismissal<\/strong>:<\/p>\n<ul>\n<li><strong>Union membership or participation in union activities outside working hours, or during working hours with the employer\u2019s consent,<\/strong><\/li>\n<li><strong>Acting as a workplace union representative,<\/strong><\/li>\n<li><strong>Filing a complaint or initiating legal action against the employer before administrative or judicial authorities,<\/strong><\/li>\n<li><strong>Discrimination based on race, color, gender, marital status, family responsibilities, pregnancy, childbirth, religion, or political opinion,<\/strong><\/li>\n<li><strong>Absence from work during the legally prohibited periods for women employees as per Article 1,<\/strong><\/li>\n<li><strong>Temporary absence due to illness or accident within the waiting period prescribed in Article 25(I)(b).<\/strong><\/li>\n<\/ul>\n<p>If a termination is based on any of the reasons listed above,<strong> the employee is entitled to file a reinstatement lawsuit in Turkey.<\/strong><\/p>\n<p><strong>Conversely, examples of valid reasons that the employer may invoke include:<\/strong><\/p>\n<ul>\n<li><strong>Low job performance,<\/strong><\/li>\n<li><strong>Failure to meet qualifications declared at the time of hiring,<\/strong><\/li>\n<li><strong>Frequent tardiness,<\/strong><\/li>\n<li><strong>Economic difficulties reducing the need for the employee\u2019s position,<\/strong><\/li>\n<li><strong>Disruptive conduct in the workplace (e.g., <a href=\"https:\/\/www.cbhukuk.com\/en\/insult-crime-in-turkey\/\">insults<\/a>, <a href=\"https:\/\/www.cbhukuk.com\/en\/fraud-crime-in-turkey\/\">fraud<\/a>, fighting),<\/strong><\/li>\n<li><strong>Reduced demand for the goods or services produced,<\/strong><\/li>\n<li><strong>Downsizing of the workplace,<\/strong><\/li>\n<li><strong>Abolition of departments or positions,<\/strong><\/li>\n<li><strong>Reorganization of the workplace structure.<\/strong><\/li>\n<\/ul>\n<p>Before terminating the employment contract in Turkey, the employer must act <strong>in good faith<\/strong>, consider <strong>alternative solutions<\/strong>, and apply termination <strong>only as a last resort<\/strong>. Otherwise, the termination will be deemed <strong>invalid<\/strong>, entitling the employee to file a reinstatement lawsuit in Turkey.<\/p>\n<p>Pursuant to <strong>Article 20\/2 of the Labor Code<\/strong>, the <strong>burden of proof<\/strong> regarding the <strong>validity of the termination lies with the<\/strong> <strong>employer<\/strong>.
