Criminal Charges Under The TPC<\/a><\/li><\/ul><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n<h1 class=\"PDq2pG_selectionAnchorContainer\" data-section-id=\"10zncb1\" data-start=\"0\" data-end=\"50\"><span class=\"ez-toc-section\" id=\"WHAT_IS_THE_PENALTY_FOR_DRINK_DRIVING_IN_TURKEY\"><\/span>WHAT IS THE PENALTY FOR DRINK DRIVING IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p data-start=\"52\" data-end=\"458\"><strong data-start=\"52\" data-end=\"289\">According to data from the Traffic Department of the General Directorate of Security, tens of thousands of drivers in Turkey are subject to administrative and criminal proceedings each year for driving under the influence of alcohol.<\/strong> This clearly demonstrates the legal significance of the <strong data-start=\"346\" data-end=\"387\">penalties for drink-driving in Turkey<\/strong>, both in terms of <strong data-start=\"406\" data-end=\"457\" data-is-only-node=\"\">administrative sanctions and criminal liability<\/strong>.<\/p>\n<p data-start=\"460\" data-end=\"931\" data-is-last-node=\"\" data-is-only-node=\"\">Driving under the influence of alcohol constitutes an <strong data-start=\"514\" data-end=\"599\">administrative offence under Article 48 of the Highway Traffic Law No. 2918 (KTK)<\/strong>. However, depending on the <strong data-start=\"627\" data-end=\"781\">blood alcohol concentration (promille level), the type of driver, or the concrete danger arising from the driver&#8217;s loss of the ability to drive safely<\/strong>, it may also constitute a <strong data-start=\"808\" data-end=\"889\">criminal offence under Article 179\/3 of the Turkish Penal Code No. 5237 (TCK)<\/strong>, namely <strong data-start=\"898\" data-end=\"931\" data-is-last-node=\"\">\u201cEndangering Traffic Safety.\u201d<\/strong><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/article>\n<\/div><\/div><div class=\"w-separator size_small\"><\/div><div class=\"w-iconbox us_custom_aea21514 iconpos_left style_default color_secondary align_left no_title\"><div class=\"w-iconbox-icon\" style=\"font-size:30px;\"><i class=\"far fa-gavel\"><\/i><\/div><div class=\"w-iconbox-meta\"><div class=\"w-iconbox-text\"><div class=\"\" data-turn-id-container=\"5c540d6b-7b31-4d1d-a147-ea7ad253139c\" data-is-intersecting=\"true\"><a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=2918&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\"><strong data-start=\"0\" data-end=\"23\">HIGHWAY TRAFFIC LAW<\/strong><\/a><\/div>\n<div data-turn-id-container=\"5c540d6b-7b31-4d1d-a147-ea7ad253139c\" data-is-intersecting=\"true\"><\/div>\n<div class=\"\" data-turn-id-container=\"5c540d6b-7b31-4d1d-a147-ea7ad253139c\" data-is-intersecting=\"true\"><strong data-start=\"25\" data-end=\"40\">Article 1 \u2013<\/strong> The purpose of this Law is to ensure traffic order on highways in terms of the safety of life and property and to determine the measures to be taken in all matters concerning traffic safety.<\/div>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_auto\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_grid cols_1 laptops-cols_inherit tablets-cols_inherit mobiles-cols_1 valign_top type_default stacking_default\"><div class=\"wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_text_column us_custom_275474cc has_text_color\"><div class=\"wpb_wrapper\"><h2 data-path-to-node=\"0\"><span class=\"ez-toc-section\" id=\"IS_DRUNK_DRIVING_PROHIBITED_UNDER_THE_HIGHWAY_TRAFFIC_LAW_IN_TURKEY\"><\/span>IS DRUNK DRIVING PROHIBITED UNDER THE HIGHWAY TRAFFIC LAW IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-path-to-node=\"1\"><strong>Drunk driving is expressly prohibited by Article 48 of Highway Traffic Law No. 2918 (HTL).<\/strong> In order to protect public order and road safety, the legislator has made<strong> driving under the influence of alcohol<\/strong> subject both to <b data-path-to-node=\"1\" data-index-in-node=\"225\">administrative sanctions<\/b><strong> (an administrative fine and seizure of the driving licence)<\/strong> and, where certain thresholds are exceeded, to <b data-path-to-node=\"1\" data-index-in-node=\"337\">criminal sanctions<\/b> <strong>in Turkey.<\/strong><\/p>\n<blockquote data-path-to-node=\"2\">\n<p data-path-to-node=\"2,0\"><b data-path-to-node=\"2,0\" data-index-in-node=\"0\">Highway Traffic Law No. 2918, Art. 48\/5:<\/b><\/p>\n<p data-path-to-node=\"2,1\"><i data-path-to-node=\"2,1\" data-index-in-node=\"0\">&#8220;Technical devices shall be used by the police in order to determine the amount of narcotic or stimulant substances and of alcohol in the blood. The procedures and principles governing the application shall be set out in the regulation.&#8221;<\/i><\/p>\n<\/blockquote>\n<p data-path-to-node=\"4\"><strong>HTL Art. 48 is the direct legal basis for the administrative fines that are imposed and for the seizure of the driving licence.<\/strong> Before such administrative measures can be taken, an authorised police officer must carry out a proper measurement with <strong>a calibrated technical device (a breathalyser)<\/strong>. <strong>Breaches of the measurement procedure, or reports drawn up by unauthorised officers,<\/strong> may later result in the report being annulled in <b data-path-to-node=\"4\" data-index-in-node=\"389\">objection<\/b> <strong>proceedings<\/strong> against the administrative fine and the seizure of the driving licence in Turkey.<\/p>\n<p data-path-to-node=\"6\"><strong>The following are frequently encountered in practice during alcohol checks;<\/strong><\/p>\n<ul>\n<li data-path-to-node=\"7,0,0\"><strong>The calibration date of the device has expired,<\/strong><\/li>\n<li data-path-to-node=\"7,1,0\"><strong>The printout from the device is not signed by the driver, or no copy of it is handed to him or her,<\/strong><\/li>\n<li data-path-to-node=\"7,2,0\"><strong>The measurement procedure is not followed, or the process is carried out by unauthorised officers,<\/strong><\/li>\n<\/ul>\n<p data-path-to-node=\"8\">and procedural breaches of this kind result in the Administrative Sanction Report and the seizure of the driver&#8217;s licence being <b data-path-to-node=\"8\" data-index-in-node=\"83\">annulled before the Criminal Judgeship of Peace<\/b>.<\/p>\n<p data-path-to-node=\"11\"><strong>Article 48 of the Law does not merely impose a prohibition; it shapes the whole administrative and criminal framework of the process:<\/strong><\/p>\n<ul>\n<li data-path-to-node=\"12,0,0\"><b data-path-to-node=\"12,0,0\" data-index-in-node=\"0\">Administrative sanctions regime (HTL Art. 48\/5):<\/b> This provision governs the<strong> administrative fines<\/strong> to be applied to drivers who exceed the prescribed per mille limits, the<strong> periods for which the driving licence is withdrawn<\/strong>, graded according to how often the offence is repeated, and <strong>the conditions under which the vehicle is removed from traffic<\/strong>.<\/li>\n<li data-path-to-node=\"12,1,0\"><b data-path-to-node=\"12,1,0\" data-index-in-node=\"0\">Sanction for refusing an alcohol test (HTL Art. 48\/9):<\/b> For drivers who refuse to undergo a technical measurement with a breath analysis device, under Turkish law it lays down <strong>a separate and heavier administrative sanction (seizure of the driving licence for 2 years and a high administrative fine)<\/strong>, regardless of whether they have in fact been drinking.<\/li>\n<li data-path-to-node=\"12,2,0\"><b data-path-to-node=\"12,2,0\" data-index-in-node=\"0\">Return of the driving licence and training:<\/b> Once the seizure periods have run, payment of the administrative fines is not enough to get the driver&#8217;s licence back; (2026)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p id=\"p-rc_fb2bd41dcfd4a8c5-28\" data-path-to-node=\"1\"><strong><span class=\"citation-81 citation-end-81\">Article 48\/5 of Highway Traffic Law No. 2918<\/span> (HTL)<\/strong> lays down a penalty for drink driving that rises in stages according to how many times the conduct has been detected <b data-path-to-node=\"1\" data-index-in-node=\"119\">within the preceding 5-year period<\/b>.<\/p>\n<ul>\n<li id=\"p-rc_fb2bd41dcfd4a8c5-29\" data-path-to-node=\"2\">\n<h3><span class=\"ez-toc-section\" id=\"Current_Administrative_Fine_Amounts_For_Drunk_Driving_in_Turkey_in_2026\"><\/span><span class=\"citation-80 citation-end-80\">Current Administrative Fine Amounts For Drunk Driving in Turkey in 2026<\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p data-path-to-node=\"3\">In line with the annual revaluation rates in Turkey, <strong>the administrative sanctions for drink driving<\/strong> <strong>have been updated as follows<\/strong>:<\/p>\n<ol>\n<li id=\"p-rc_fb2bd41dcfd4a8c5-30\" data-path-to-node=\"4,0,0\"><b data-path-to-node=\"4,0,0\" data-index-in-node=\"0\"><span class=\"citation-79 citation-end-79\">1st Time Caught Drink Driving:<\/span><\/b> <span class=\"citation-78\">The driver is fined <\/span><b data-path-to-node=\"4,0,0\" data-index-in-node=\"27\"><span class=\"citation-78\">11,629 TL<\/span><\/b> <i data-path-to-node=\"4,0,0\" data-index-in-node=\"37\"><span class=\"citation-78\">(or the current tariffs under the new legislation)<\/span><\/i><span class=\"citation-78\"> as an administrative monetary fine, the driving licence is seized for <\/span><b data-path-to-node=\"4,0,0\" data-index-in-node=\"147\"><span class=\"citation-78\">6 months<\/span><\/b><span class=\"citation-78\">, the vehicle is impounded and <\/span><b data-path-to-node=\"4,0,0\" data-index-in-node=\"201\"><span class=\"citation-78\">20 penalty points<\/span><\/b><span class=\"citation-78 citation-end-78\"> are recorded.<\/span><\/li>\n<li id=\"p-rc_fb2bd41dcfd4a8c5-31\" data-path-to-node=\"4,1,0\"><b data-path-to-node=\"4,1,0\" data-index-in-node=\"0\"><span class=\"citation-77 citation-end-77\">2nd Time Caught Drink Driving:<\/span><\/b> Where the offence is repeated, the administrative monetary fine rises to <b data-path-to-node=\"4,1,0\" data-index-in-node=\"53\">14,584 TL<\/b>. <span class=\"citation-76\">The driving licence is seized for <\/span><b data-path-to-node=\"4,1,0\" data-index-in-node=\"93\"><span class=\"citation-76\">2 years<\/span><\/b><span class=\"citation-76\">, the vehicle is impounded and <\/span><b data-path-to-node=\"4,1,0\" data-index-in-node=\"148\"><span class=\"citation-76\">20 penalty points<\/span><\/b><span class=\"citation-76 citation-end-76\"> are applied.<\/span><\/li>\n<li id=\"p-rc_fb2bd41dcfd4a8c5-32\" data-path-to-node=\"4,2,0\"><b data-path-to-node=\"4,2,0\" data-index-in-node=\"0\"><span class=\"citation-75 citation-end-75\">3rd and Subsequent Times Caught:<\/span><\/b> <span class=\"citation-74\">The administrative fine is <\/span><b data-path-to-node=\"4,2,0\" data-index-in-node=\"46\"><span class=\"citation-74\">23,437 TL<\/span><\/b><span class=\"citation-74 citation-end-74\">.<\/span> <span class=\"citation-73\">The driving licence is seized for <\/span><b data-path-to-node=\"4,2,0\" data-index-in-node=\"91\"><span class=\"citation-73\">5 years<\/span><\/b><span class=\"citation-73\">, the vehicle is removed from traffic and <\/span><b data-path-to-node=\"4,2,0\" data-index-in-node=\"146\"><span class=\"citation-73\">20 penalty points<\/span><\/b><span class=\"citation-73 citation-end-73\"> are recorded.<\/span><\/li>\n<\/ol>\n<p data-path-to-node=\"5\"><strong><i data-path-to-node=\"5\" data-index-in-node=\"0\">(Note: Administrative fine amounts are standard throughout the country and do not vary from province to province.)<\/i><\/strong><\/p>\n<ul>\n<li data-path-to-node=\"7\">\n<h3><span class=\"ez-toc-section\" id=\"The_Repeat_Offence_Rule_and_Discounted_Payment_in_Turkey\"><\/span>The Repeat Offence Rule and Discounted Payment in Turkey<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p>In establishing how many times a driver has been caught drunk driving, <strong>the 5-year period running back from the date of the first offence<\/strong> is taken as the basis. The seizure periods are set, independently of the blood alcohol level found (provided that the legal limit has been exceeded), according to how many times the conduct has been repeated <b data-path-to-node=\"1\" data-index-in-node=\"261\">within the preceding 5 years<\/b> under Turkish law:<\/p>\n<ol>\n<li><b data-path-to-node=\"2,0,0\" data-index-in-node=\"0\">1st detection:<\/b> The driving licence is seized for <b data-path-to-node=\"2,0,0\" data-index-in-node=\"30\">6 months<\/b>.<\/li>\n<li><b data-path-to-node=\"2,1,0\" data-index-in-node=\"0\">2nd detection:<\/b> The driving licence is seized for <b data-path-to-node=\"2,1,0\" data-index-in-node=\"30\">2 years<\/b>.<\/li>\n<li><b data-path-to-node=\"2,2,0\" data-index-in-node=\"0\">3rd and subsequent detections:<\/b> The driving licence is seized for <b data-path-to-node=\"2,2,0\" data-index-in-node=\"44\">5 years<\/b>.<\/li>\n<\/ol>\n<p data-path-to-node=\"3\">In addition, <b data-path-to-node=\"3\" data-index-in-node=\"96\">20 penalty points<\/b> are recorded on the driver&#8217;s licence record for every administrative measure taken because of drink driving. A high alcohol level <strong>does not in itself extend the administrative seizure period<\/strong>; it may, however, be treated<strong> by the court as an aggravating factor when a prison sentence or a judicial fine is assessed in the criminal proceedings (TPC Art. 179)<\/strong>.<\/p>\n<h2 data-path-to-node=\"0\"><span class=\"ez-toc-section\" id=\"IS_THE_VEHICLE_IMPOUNDED_FOR_DRINK_DRIVING_IN_TURKEY\"><\/span>IS THE VEHICLE IMPOUNDED FOR DRINK DRIVING IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-path-to-node=\"1\">Under the Highway Traffic Law, where a driver is found to be over the legal alcohol limits, <strong>the vehicle<\/strong> <b data-path-to-node=\"1\" data-index-in-node=\"123\">is removed from traffic regardless of how many times the offence has been committed<\/b> <strong>and is impounded as a safety measure.<\/strong><\/p>\n<ul>\n<li data-path-to-node=\"3\">\n<h3><span class=\"ez-toc-section\" id=\"The_Impound_Lot_Procedure_in_Turkey\"><\/span>The Impound Lot Procedure in Turkey<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p data-path-to-node=\"4\">Because a drunk driver is treated at the moment of the stop as unable to control the vehicle safely, <strong>an administrative measure is taken in Turkey by the police (traffic police or gendarmerie)<\/strong>:<\/p>\n<ol>\n<li data-path-to-node=\"5,0,0\"><b data-path-to-node=\"5,0,0\" data-index-in-node=\"0\">Towing and impounding:<\/b> The vehicle is towed by an authorised tow truck to the nearest <strong>impound lot<\/strong> and kept there.<\/li>\n<li data-path-to-node=\"5,1,0\"><b data-path-to-node=\"5,1,0\" data-index-in-node=\"0\">Collecting the vehicle from the lot:<\/b> The vehicle is <strong>never released to the driver found to have been drinking.<\/strong> To get the vehicle out of the lot, either <b data-path-to-node=\"5,1,1,0,0\" data-index-in-node=\"58\">a second driver<\/b> who is sober and holds a valid driver&#8217;s licence must come to the lot, or the vehicle must be loaded onto a <b data-path-to-node=\"5,1,1,1,0\" data-index-in-node=\"38\">tow truck or recovery vehicle<\/b> and taken away from the impound lot.<\/li>\n<li data-path-to-node=\"5,2,0\"><b data-path-to-node=\"5,2,0\" data-index-in-node=\"0\">Lot and towing charges:<\/b> The vehicle is not released until<strong> the impound lot fee calculated over the time the vehicle has been kept there and the towing costs<\/strong> have been paid.<\/li>\n<\/ol>\n<ul>\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Where_The_Vehicle_Belongs_to_Someone_Else\"><\/span>Where The Vehicle Belongs to Someone Else<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p data-path-to-node=\"8\"><strong>The fact that the registered owner of the vehicle is a third person other than the drunk driver at the wheel<\/strong> <b data-path-to-node=\"8\" data-index-in-node=\"106\">does not prevent the vehicle from being taken out of traffic.<\/b> Under Turkish law this measure is not a penalty imposed on the vehicle but an immediate <strong>safety measure protecting public safety.<\/strong> The administrative measure is therefore applied and the vehicle is towed to the lot even where it belongs <strong>to another person, to a car rental company (rent a car) or to a legal entity (a company car)<\/strong>. The registered owner may apply to the impound lot with valid identification and a driver&#8217;s licence and recover the vehicle<strong> on payment of the towing and lot charges<\/strong>.<\/p>\n<h2 data-path-to-node=\"9\"><span class=\"ez-toc-section\" id=\"CAN_PENALTY_POINTS_LEAD_TO_CANCELLATION_OF_THE_DRIVING_LICENCE_IN_TURKEY\"><\/span>CAN PENALTY POINTS LEAD TO CANCELLATION OF THE DRIVING LICENCE IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-path-to-node=\"10\">The <b data-path-to-node=\"10\" data-index-in-node=\"56\">20 penalty points<\/b> recorded on the driver&#8217;s record for drink driving form part of the <strong>general penalty points<\/strong> system laid down in <strong>Article 118 of Law No. 2918.<\/strong><\/p>\n<ul>\n<li data-path-to-node=\"11,0,0\"><b data-path-to-node=\"11,0,0\" data-index-in-node=\"0\">The 100 penalty point limit:<\/b> Where a driver in Turkey reaches a total of 100 penalty points within one year (12 months), the driving licence <b data-path-to-node=\"11,0,0\" data-index-in-node=\"110\">is suspended for 2 months<\/b>, and that driver must undergo a <b data-path-to-node=\"11,0,0\" data-index-in-node=\"149\">psychotechnical assessment<\/b> and the <b data-path-to-node=\"11,0,0\" data-index-in-node=\"179\">Driver Behaviour Development Training (S\u00dcDGE)<\/b>.<\/li>\n<li data-path-to-node=\"11,1,0\"><b data-path-to-node=\"11,1,0\" data-index-in-node=\"0\">Risk of licence cancellation:<\/b> Where <strong>the psychotechnical assessment produces a negative result, the training is not attended, or 100 penalty points are reached for a second or a third time in the same year<\/strong>, the legal consequence is <strong>indefinite cancellation of the driver&#8217;s licence or its withdrawal for a longer period<\/strong>.<\/li>\n<\/ul>\n<h2 data-path-to-node=\"0\"><span class=\"ez-toc-section\" id=\"HOW_IS_THE_ALCOHOL_LEVEL_MEASURED_IN_TURKEY\"><\/span>HOW IS THE ALCOHOL LEVEL MEASURED IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-path-to-node=\"1\">In traffic checks the blood alcohol level is established by <strong>two basic legal and technical methods,<\/strong> within the framework of Art. 48\/5 of Highway Traffic Law No. 2918 and <b data-path-to-node=\"1\" data-index-in-node=\"103\">Article 97 of the Highway Traffic Regulation<\/b>:<\/p>\n<h3 data-path-to-node=\"3\"><span class=\"ez-toc-section\" id=\"1_Measurement_With_a_Technical_Device_Breath_Analysis_With_a_Breathalyser\"><\/span>1. Measurement With a Technical Device (Breath Analysis With a Breathalyser)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-path-to-node=\"4\">The primary method in general roadside checks carried out by<strong> the police (traffic police or gendarmerie) in Turkey<\/strong> is measurement <b data-path-to-node=\"4\" data-index-in-node=\"111\">with technical devices that analyse the breath (a breath analysis device)<\/b>.<\/p>\n<ul>\n<li data-path-to-node=\"5,0,0\"><b data-path-to-node=\"5,0,0\" data-index-in-node=\"0\">Calibration and reliability of the device:<\/b> The breath test devices used must comply with the standards of the Ministry of Industry and Technology and must have had their <b data-path-to-node=\"5,0,0\" data-index-in-node=\"122\">periodic calibration and maintenance certification<\/b> carried out. Measurements taken with devices whose calibration has expired amount to <strong>unlawfully obtained evidence<\/strong> before the Turkish courts.<\/li>\n<li data-path-to-node=\"5,1,0\"><b data-path-to-node=\"5,1,0\" data-index-in-node=\"0\">The printout requirement:<\/b> It is a rule of procedure that, once the measurement is complete, <strong>a copy of the written printout (slip\/report) produced by the device is handed to the driver<\/strong> and<strong> that the report is signed by him or her<\/strong>.<\/li>\n<\/ul>\n<h3 data-path-to-node=\"7\"><span class=\"ez-toc-section\" id=\"2_Laboratory_Analysis_of_Blood_Forensic_Blood_Test\"><\/span>2. Laboratory Analysis of Blood (Forensic Blood Test)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-path-to-node=\"8\">Although measurement with <strong>a technical device<\/strong> is the rule, under Turkish legislation the alcohol level must be established <b data-path-to-node=\"8\" data-index-in-node=\"106\">by taking a blood sample at an official health institution<\/b> where certain conditions are met:<\/p>\n<ul>\n<li data-path-to-node=\"9,0,0\"><b data-path-to-node=\"9,0,0\" data-index-in-node=\"0\">The breathalyser result is challenged on concrete grounds:<\/b> Where the driver has blown into the breathalyser but <strong>immediately challenges the result on concrete grounds (e.g. medication, an inhaler, an asthma spray, or an alleged fault in the device)<\/strong>, the police arrange <strong>immediate referral to a health institution<\/strong>.<\/li>\n<li data-path-to-node=\"9,1,0\"><b data-path-to-node=\"9,1,0\" data-index-in-node=\"0\">The device malfunctions or cannot take a measurement:<\/b> Where this is technically impossible or the device is inadequate, <strong>the blood analysis method<\/strong> is used.<\/li>\n<li>\n<p data-path-to-node=\"9,2,0\"><b data-path-to-node=\"9,2,0\" data-index-in-node=\"0\">Accidents with injury or death and cases of unconsciousness:<\/b> Where, because of the accident, the driver is <strong>unconscious, connected to a ventilator or physically unable to blow into the device<\/strong>, a blood test is carried out.<\/p>\n<\/li>\n<\/ul>\n<blockquote data-path-to-node=\"17\">\n<p data-path-to-node=\"17,0\"><b data-path-to-node=\"17,0\" data-index-in-node=\"0\">Legal importance:<\/b> Forensic medicine and expert calculations that take account of the time elapsed between the breath test and the taking of blood at the hospital, and of the rate at which alcohol leaves the body during that time <strong>(an average decrease of 0.15 per mille per hour)<\/strong>, are one of the most important pieces of evidence <b data-path-to-node=\"17,0\" data-index-in-node=\"233\">in proceedings for annulment of the administrative penalty<\/b> <strong>in Turkey.<\/strong><\/p>\n<\/blockquote>\n<h2 data-path-to-node=\"0\"><span class=\"ez-toc-section\" id=\"WHAT_IS_THE_PENALTY_FOR_REFUSING_TO_BLOW_INTO_THE_BREATHALYSER_IN_TURKEY_2026\"><\/span>WHAT IS THE PENALTY FOR REFUSING TO BLOW INTO THE BREATHALYSER IN TURKEY? (2026)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-path-to-node=\"1\"><strong>For drivers who refuse an alcohol examination at a traffic check, that is, who refuse to blow into the breathalyser or to give a blood test at a health institution after referral by the police<\/strong>, a separate and heavier administrative sanction is laid down by <strong>Highway Traffic Law No. 2918 (HTL)<\/strong> <b data-path-to-node=\"1\" data-index-in-node=\"211\">Art. 48\/9<\/b>.<\/p>\n<h3 data-path-to-node=\"2\"><span class=\"ez-toc-section\" id=\"1-_Sanctions_For_Refusing_an_Alcohol_Test_in_Turkey_in_2026\"><\/span>1- Sanctions For Refusing an Alcohol Test in Turkey in 2026<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li data-path-to-node=\"3,0,0\"><b data-path-to-node=\"3,0,0\" data-index-in-node=\"0\">Administrative fine:<\/b> A driver who refuses an alcohol or drug test in Turkey is given an administrative monetary fine of <b data-path-to-node=\"3,0,0\" data-index-in-node=\"62\">33,326 TL<\/b>.<\/li>\n<li data-path-to-node=\"3,1,0\"><b data-path-to-node=\"3,1,0\" data-index-in-node=\"0\">Seizure of the driving licence:<\/b> The driving licence is withdrawn outright for <b data-path-to-node=\"3,1,0\" data-index-in-node=\"55\">2 years<\/b>. <i data-path-to-node=\"3,1,0\" data-index-in-node=\"82\">(Note: The 2-year statutory seizure period laid down in the Law is applied).<\/i><\/li>\n<li data-path-to-node=\"3,2,0\"><b data-path-to-node=\"3,2,0\" data-index-in-node=\"0\">Additional sanctions:<\/b> The vehicle is removed from traffic and <b data-path-to-node=\"3,2,0\" data-index-in-node=\"60\">20 penalty points<\/b> are recorded on the driver&#8217;s record.<\/li>\n<\/ul>\n<h3 data-path-to-node=\"5\"><span class=\"ez-toc-section\" id=\"2-_What_is_The_Legal_Nature_of_Refusing_an_Alcohol_Test_and_What_Critical_Mistakes_Are_Made\"><\/span>2- What is The Legal Nature of Refusing an Alcohol Test, and What Critical Mistakes Are Made?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-path-to-node=\"6\">With this aggravated rule the legislator aimed <strong>to prevent drivers from escaping criminal and administrative liability<\/strong> by avoiding the technical measurement in Turkey.<\/p>\n<ol>\n<li data-path-to-node=\"7,0,0\"><b data-path-to-node=\"7,0,0\" data-index-in-node=\"0\">An administrative offence that requires no specific alcohol level:<\/b> The most striking feature of the sanction for refusing the test is that, <b data-path-to-node=\"7,0,0\" data-index-in-node=\"110\">regardless of whether the driver in fact has alcohol in the blood<\/b>, it is applied of the authorities&#8217; own motion solely because of the act of <strong>&#8220;obstructing or refusing the measurement&#8221;<\/strong>.<\/li>\n<li data-path-to-node=\"7,1,0\"><b data-path-to-node=\"7,1,0\" data-index-in-node=\"0\">The driver&#8217;s own statement carries no weight:<\/b> A statement by the driver along the lines of <strong><i data-path-to-node=\"7,1,0\" data-index-in-node=\"50\">&#8220;I have not been drinking, so I am not going to blow&#8221;<\/i><\/strong> is not accepted as a legal justification. Turkey.<\/strong> The court with jurisdiction is <strong>the Criminal Judgeship of Peace for the place where the penalty was issued.<\/strong><\/p>\n<p data-path-to-node=\"4,1,0\"><strong>The time limit for an appeal against the penalty is 15 days from the date on which it was pronounced to the driver in person or served at his or her address.<\/strong> This is a strict time limit, and once it the seizure of the driver&#8217;s licence can be taken to court.<\/strong><\/div>\n<\/div>\n<h2 data-path-to-node=\"0\"><span class=\"ez-toc-section\" id=\"HOW_DOES_THE_PROCESS_OF_GETTING_THE_DRIVING_LICENCE_BACK_WORK_IN_TURKEY\"><\/span>HOW DOES THE PROCESS OF GETTING THE DRIVING LICENCE BACK WORK IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-path-to-node=\"1\"><strong>Where a driving licence has been temporarily withdrawn (seized) because of drunk driving, certain statutory conditions must be met before it can be returned once the administrative seizure period has run.<\/strong> The licence does not become active again by itself or automatically as soon as the period ends; <strong>the driver must apply in person and satisfy the conditions<\/strong> under Turkish law.<\/p>\n<ul>\n<li data-path-to-node=\"2\">\n<h3><span class=\"ez-toc-section\" Law No. 2918 (6 months, 2 years or 5 years) has run in full. <\/strong>Once the seizure period has ended, drivers may apply with a petition and the necessary documents to the <b data-path-to-node=\"3,1,0\" data-index-in-node=\"91\">nearest Traffic Registration \/ Traffic Inspection Branch Office<\/b>. It is no obstacle to the application that the province or district where the licence was first handed over is different from the place of residence.<\/p>\n<ul>\n<li data-path-to-node=\"5\">\n<h3><span class=\"ez-toc-section\" id=\"Is_The_Drivers_Licence_Returned_Before_The_Administrative_Fine_Has_Been_Paid_in_Full\"><\/span>Is The Driver&#8217;s Licence Returned Before The Administrative Fine Has Been Paid in Full?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p data-path-to-node=\"7\">Under Highway Traffic Law No. 2918, <strong>before a temporarily withdrawn driving licence can be returned<\/strong>, <b data-path-to-node=\"7\" data-index-in-node=\"139\">the administrative fine imposed for the conduct, together with any other traffic fines, must have been paid in full<\/b>.<\/p>\n<p data-path-to-node=\"8,0,0\"><strong>Administrative fines that are not paid within the time limit become final and are transferred to the tax office.<\/strong> From that point on the debt is collected <strong>under Law No. 6183, with late payment interest and through enforcement or electronic attachment<\/strong>. As long as the debt is not cleared, however, <strong>the licence cannot lawfully be returned in Turkey.<\/strong><\/p>\n<ul>\n<li data-path-to-node=\"10\">\n<h3><span class=\"ez-toc-section\" id=\"Are_a_Health_Report_SUDGE_and_a_Psychotechnical_Assessment_Required\"><\/span>Are a Health Report, S\u00dcDGE and a Psychotechnical Assessment Required?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p data-path-to-node=\"11\">The conditions required under Turkish law vary according to the reason why the licence was withdrawn and how many times the offence has been repeated:<\/p>\n<ol>\n<li><b data-path-to-node=\"12,0,0\" data-index-in-node=\"0\">1st time caught (6-month seizure):<\/b> It is enough that the period has run and the traffic fine has been paid. Compulsory Financial Liability (Traffic) Insurance And The Right of Recourse<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-path-to-node=\"7\">Under the General Conditions of Compulsory Motor Third Party Liability Insurance, traffic insurance is required in the first place, under Turkish law, to compensate <strong>the bodily and material losses of injured third parties within the policy limits<\/strong>. After paying compensation to the victim, however, the insurer is entitled <strong>against its own insured or against the drunk driver<\/strong> <b data-path-to-node=\"7\" data-index-in-node=\"330\">to a right of recourse (to recover the amount paid)<\/b>.<\/p>\n<blockquote data-path-to-node=\"8\">\n<p data-path-to-node=\"8,0\"><b data-path-to-node=\"8,0\" data-index-in-node=\"0\">The causal link (exclusivity) principle:<\/b><\/p>\n<p data-path-to-node=\"8,1\">According to the settled case law of the Court of Cassation, before an insurer can exercise a right of recourse on grounds of alcohol in an accident, or refuse cover under a kasko policy, <b data-path-to-node=\"8,1\" data-index-in-node=\"160\">the accident must have occurred solely (exclusively) under the influence of alcohol<\/b><strong>; this is an absolute condition.<\/strong> Where it is not exclusively alcohol but <strong>external factors such as the primary fault of the other party, a defect in the road or adverse weather conditions that are decisive in how the accident came about<\/strong>, the mere fact that the driver had been drinking does not give the insurer a right of recourse.<\/p>\n<\/blockquote>\n<h3 data-path-to-node=\"9\"><span class=\"ez-toc-section\" id=\"2_The_Liability_of_Comprehensive_kasko_Insurance\"><\/span>2. The Liability of Comprehensive (kasko) Insurance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-path-to-node=\"10\"><strong>Under the General Conditions of Comprehensive Motor Insurance, damage occurring while the vehicle is being driven exclusively under the influence of alcohol<\/strong> <b data-path-to-node=\"10\" data-index-in-node=\"136\">is excluded from cover<\/b>. On that basis the kasko insurer is entitled <strong>to refuse to pay for the damage to the drunk driver&#8217;s own vehicle<\/strong>. In proceedings before the Turkish courts, the existence of a causal link must be proved with concrete data<strong> by forensic medicine and neurology or traffic expert witnesses<\/strong>.<\/p>\n<ul>\n<li data-path-to-node=\"12\">\n<h3><span class=\"ez-toc-section\" id=\"The_Right_of_Injured_Third_Parties_To_Claim_Directly_Against_The_Driver_And_The_Owner\"><\/span>The Right of Injured Third Parties To Claim Directly Against The Driver And The Owner<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p data-path-to-node=\"13\"><strong>Third parties injured in a traffic accident (the casualties)<\/strong> may, for losses exceeding the insurance limits or for claims of non-pecuniary damages, and within the framework of<strong> the tort provisions of the Turkish Code of Obligations No. 6098 and the operator and driver liability provisions of Law No. 2918<\/strong>:<\/p>\n<ol>\n<li data-path-to-node=\"14,0,0\"><b data-path-to-node=\"14,0,0\" data-index-in-node=\"0\">Against the drunk driver (the actual perpetrator),<\/b><\/li>\n<li data-path-to-node=\"14,1,0\"><b data-path-to-node=\"14,1,0\" data-index-in-node=\"0\">Against the operator or owner of the vehicle (jointly and severally liable),<\/b><\/li>\n<\/ol>\n<p data-path-to-node=\"15\">bring a direct<strong> claim for pecuniary and non-pecuniary damages<\/strong>. The fact that the driver had been drinking is one of <strong>the main matters that aggravate the degree of fault in tort and are taken into account when the amount of damages is set<\/strong> under Turkish law.<\/p>\n<h2 data-path-to-node=\"0\"><span class=\"ez-toc-section\" id=\"DOES_A_DRUNK_DRIVING_PENALTY_GO_ON_THE_CRIMINAL_RECORD_IN_TURKEY\"><\/span>DOES A DRUNK DRIVING PENALTY GO ON THE CRIMINAL RECORD IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-path-to-node=\"1\"><strong>Whether the sanctions applied for drink driving are entered on the criminal record depends on the legal nature of the conduct \u2014 that is, on whether it amounts to an administrative offence or to a criminal offence:<\/strong><\/p>\n<ul data-path-to-node=\"2\">\n<li>\n<p data-path-to-node=\"2,0,0\"><b data-path-to-node=\"2,0,0\" data-index-in-node=\"0\">Administrative fines and measures:<\/b> Decisions imposing <strong>administrative fines and the temporary withdrawal of the driver&#8217;s licence<\/strong> under Article 48 of Highway Traffic Law No. 2918 are administrative in nature. They <b data-path-to-node=\"2,0,0\" data-index-in-node=\"229\">are not entered on the criminal record<\/b>; they are recorded only in the <strong>driver record system<\/strong> of the General Directorate of Security.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"2,1,0\"><b data-path-to-node=\"2,1,0\" data-index-in-node=\"0\">TPC Art. 179 and criminal convictions:<\/b> Where the blood alcohol level is above 1.00 per mille, or where the driver takes to the road having lost the ability to drive safely because of alcohol, and proceedings are brought under<strong> TPC Art. 179\/2-3<\/strong>, <b data-path-to-node=\"2,1,0\" data-index-in-node=\"239\">convictions to a prison sentence or a judicial fine are entered on the criminal record once the decision becomes final<\/b>.<\/p>\n<\/li>\n<\/ul>\n<blockquote data-path-to-node=\"3\">\n<p data-path-to-node=\"3,0\"><b data-path-to-node=\"3,0\" data-index-in-node=\"0\">Effects of a criminal record:<\/b><\/p>\n<p data-path-to-node=\"3,1\">Convictions under TPC Art. 179 can be moved to the archive record or deleted under the criminal records legislation once the conditions for this are met. Those criminal and archive records are nevertheless taken into account, within the framework of public order and the legislation, <strong>in appointments to the civil service and in entry to professions subject to a security investigation and an archive search (the bar, the bench, police duties and the like)<\/strong> in Turkey.<\/p>\n<\/blockquote>\n<h2 data-path-to-node=\"5\"><span class=\"ez-toc-section\" id=\"ARE_THERE_EXTRA_LEGAL_CONSEQUENCES_OF_DRUNK_DRIVING_FOR_FOREIGN_DRIVERS_IN_TURKEY\"><\/span>ARE THERE EXTRA LEGAL CONSEQUENCES OF DRUNK DRIVING FOR FOREIGN DRIVERS IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-path-to-node=\"6\"><strong>Foreign nationals who drive within the borders of Turkey on either a national or an international driving permit are subject in exactly the same way to Law No. 2918 and to the Turkish Penal Code.<\/strong> For foreign drivers, alongside the administrative and criminal sanctions, serious consequences can also arise in terms of <a href=\"https:\/\/www.cbhukuk.com\/en\/practice-areas\/turkish-citizenship\/\"><strong>immigration law in Turkey<\/strong><\/a>:<\/p>\n<h3 data-path-to-node=\"7\"><span class=\"ez-toc-section\" id=\"1_Effect_On_Residence_And_Work_Permit_Applications\"><\/span>1. Effect On Residence And Work Permit Applications<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-path-to-node=\"8\"><strong>Being prosecuted or convicted under TPC Art. 179<\/strong> is assessed under the <b data-path-to-node=\"8\" data-index-in-node=\"150\">&#8220;public order or public health&#8221;<\/b> criteria of the Law on Foreigners and International Protection No. 6458 (LFIP). This can be a legal ground for <strong>refusing the foreign national&#8217;s work permit or <a href=\"https:\/\/www.cbhukuk.com\/en\/residence-permit-refusal-appeal-in-turkey\/\">residence permit applications<\/a><\/strong> or for <strong>cancelling existing permits<\/strong>.<\/p>\n<h3 data-path-to-node=\"9\"><span class=\"ez-toc-section\" id=\"2_Risk_of_Deportation_Deport\"><\/span>2. Risk of Deportation (Deport)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-path-to-node=\"10\">Under Turkish legislation, where drink driving <strong>causes an accident with death or injury<\/strong> or <strong>leads to a conviction for a criminal offence that breaches public order<\/strong>, it is possible for <b data-path-to-node=\"10\" data-index-in-node=\"209\">a deportation decision (deport)<\/b> to be taken against the foreign national under LFIP Art. 54, and for a restriction code banning entry to Turkey to be placed on his or her record.<\/p>\n<h2 data-path-to-node=\"0\"><span class=\"ez-toc-section\" id=\"WHAT_ARE_THE_CRIMINAL_CONSEQUENCES_OF_RESISTING_A_POLICE_OFFICER_AT_AN_ALCOHOL_CHECK_IN_TURKEY\"><\/span>WHAT ARE THE CRIMINAL CONSEQUENCES OF RESISTING A POLICE OFFICER AT AN ALCOHOL CHECK IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-path-to-node=\"1\"><strong>Unlawful attitudes and behaviour towards police officers (police or gendarmerie) during a traffic check, aimed at obstructing the alcohol examination,<\/strong> constitute separate criminal offences under the <b data-path-to-node=\"1\" data-index-in-node=\"221\">Turkish Penal Code No. 5237 (TPC)<\/b>, entirely independently of the administrative sanctions in Law No. 2918.<\/p>\n<h3 data-path-to-node=\"2\"><span class=\"ez-toc-section\" id=\"1_Insulting_a_Public_Officer_TPC_Art_1253-a\"><\/span>1. Insulting a Public Officer (TPC Art. 125\/3-a)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-path-to-node=\"3\">Where degrading words that harm the honour and dignity of the officer carrying out the alcohol check are used, the <a href=\"https:\/\/www.cbhukuk.com\/en\/insult-crime-in-turkey\/\"><b data-path-to-node=\"3\" data-index-in-node=\"127\">offence of insulting<\/b><\/a><b data-path-to-node=\"3\" data-index-in-node=\"127\"> a public officer on account of his or her duty<\/b> is committed in Turkey.<\/p>\n<ul>\n<li data-path-to-node=\"4,0,0\">Committing the offence of insult against a public officer on account of his or her duty is <b data-path-to-node=\"4,0,0\" data-index-in-node=\"73\">an aggravated form<\/b> of that offence, and the lower limit of the sentence laid down in the Law <b data-path-to-node=\"4,0,0\" data-index-in-node=\"131\">cannot be less than 1 year<\/b>.<\/li>\n<li data-path-to-node=\"4,1,0\">Being under the influence of alcohol is <strong>not accepted under the Turkish Penal Code (TPC Art. 34\/1 &#8211; voluntary intoxication)<\/strong> <strong>as a ground that removes or reduces criminal capacity<\/strong>.<\/li>\n<\/ul>\n<h3 data-path-to-node=\"5\"><span class=\"ez-toc-section\" id=\"2_Resisting_an_Officer_To_Prevent_The_Performance_of_duty_TPC_Art_265\"><\/span>2. Resisting an Officer To Prevent The Performance of duty (TPC Art. 265)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-path-to-node=\"6\">Where <strong>an attempt is made to prevent the alcohol measurement by using physical force or threats<\/strong> against the officers carrying out the check, <b data-path-to-node=\"6\" data-index-in-node=\"142\">the offence of resisting an officer to prevent the performance of duty <\/b>comes into play.<\/p>\n<ul>\n<li data-path-to-node=\"7,0,0\">For this offence the legislator has laid down <b data-path-to-node=\"7,0,0\" data-index-in-node=\"25\">a prison sentence of 6 months to 3 years<\/b> in Turkey.<\/li>\n<li data-path-to-node=\"7,1,0\">Where the act is <strong>committed with a weapon, by more than one person together, or by persons who present themselves as public officers<\/strong>, the sentences are increased further still.<\/li>\n<\/ul>\n<h2 data-path-to-node=\"9\"><span class=\"ez-toc-section\" id=\"EXTRA_LEGAL_CONSEQUENCES_OF_DRINK_DRIVING_FOR_PROFESSIONAL_AND_COMMERCIAL_DRIVERS_IN_TURKEY\"><\/span>EXTRA LEGAL CONSEQUENCES OF DRINK DRIVING FOR PROFESSIONAL AND COMMERCIAL DRIVERS IN TURKEY<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p data-path-to-node=\"10\">For <strong>professional drivers working with commercial vehicles, taxis, buses or lorries, or in goods and passenger transport<\/strong>, a finding of DUI also has direct and serious consequences for their <strong>freedom to work and their status under employment law<\/strong>.<\/p>\n<h3 data-path-to-node=\"11\"><span class=\"ez-toc-section\" id=\"1_Termination_of_The_Employment_Contract_For_Just_Cause_Labour_Law_No_4857_Art_25\"><\/span>1. Termination of The Employment Contract For Just Cause (Labour Law No. 4857, Art. 25)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-path-to-node=\"12\"><strong>Seizure of the driving licence under Law No. 2918 (6 months, 2 years or 5 years)<\/strong> makes it impossible for a commercial vehicle driver <strong>to perform the obligation undertaken in the employment contract (driving and operating the vehicle).<\/strong><\/p>\n<ul>\n<li data-path-to-node=\"13,0,0\"><b data-path-to-node=\"13,0,0\" data-index-in-node=\"0\">Right to terminate for just cause:<\/b> On the ground that the driver&#8217;s licence has been seized and the vehicle can no longer be driven, the employer may have the power under <b data-path-to-node=\"13,0,0\" data-index-in-node=\"107\">Labour Law Art. 25\/II<\/b> (situations contrary to the rules of morality and good faith and the like) or <b data-path-to-node=\"13,0,0\" data-index-in-node=\"193\">Art. 25\/III<\/b> (compelling reasons) <strong>to dismiss the driver without paying <a href=\"https:\/\/www.cbhukuk.com\/en\/severance-pay-calculation\/\">severance pay<\/a>, <a href=\"https:\/\/www.cbhukuk.com\/en\/notice-pay-in-turkey\/\">notice pay<\/a> or any other <a href=\"https:\/\/www.cbhukuk.com\/en\/worker-compensation-rights-in-turkey\/\">dismissal compensation<\/a>, by <a href=\"https:\/\/www.cbhukuk.com\/en\/types-of-employment-contracts\/\">terminating the employment contract for just cause<\/a>. <\/strong>In that case, if the employer ends the worker&#8217;s employment contract with<strong> code number 25 as the <a href=\"https:\/\/www.cbhukuk.com\/en\/employment-termination-codes\/\">SGK employment termination code<\/a><\/strong>, this will cause<strong> an unfavourable assessment<\/strong> when the worker applies for a new job.<\/li>\n<li data-path-to-node=\"13,1,0\"><b data-path-to-node=\"13,1,0\" data-index-in-node=\"0\">Assessment of the worker&#8217;s rights:<\/b> Whether the termination rests on just cause, and <a href=\"https:\/\/www.cbhukuk.com\/en\/wrongful-termination\/\"><strong>the worker&#8217;s rights<\/strong><\/a>, are assessed according to the principles of employment law in Turkey, in the light of the driver&#8217;s duties at the workplace, whether the employment contract contains specific clauses on driving under the influence of alcohol, and the circumstances of the individual case.<\/li>\n<\/ul>\n<h3 data-path-to-node=\"14\"><span class=\"ez-toc-section\" id=\"2_The_Position_of_Professional_Competence_SRC_And_Psychotechnical_Certificates\"><\/span>2. Where <strong>this period, which starts to run from the date of service or pronouncement, is missed, or the matter is left unpursued before an authority that has no jurisdiction<\/strong>, <strong>the administrative sanctions become final<\/strong> even if there was police irregularity or a fault in the technical device in the particular case.
