MASAK INVESTIGATION IN TURKEY: BANK ACCOUNT BLOCK AND THE LEGAL APPLICATION PROCESS<span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><b>In 2024 the Financial Crimes Investigation Board (MASAK) received 558,595 suspicious transaction reports (STR)<\/b>, these reports concerned <b>1,065,825 people<\/b>, and of the postponement requests made in the same year,<b> a postponement decision was issued in 4,994 of them<\/b>. These figures show that <b>a cross-border transfer being taken into a MASAK investigation<\/b> is not an exceptional malfunction but <b>an ordinary outcome of the way the financial supervision system works in Turkey<\/b>.<\/p>\n<p><b>A MASAK investigation<\/b> is the process in which <strong><a href=\"https:\/\/www.cbhukuk.com\/en\/taxation-of-foreign-sourced-income-in-turkey\/\">a money transfer from abroad<\/a><\/strong> is examined under <b>Law No. 5549 on the Prevention of Laundering Proceeds of Crime<\/b> to determine whether it rests on a legitimate economic justification.<\/p>\n<p>For a person whose account has been credited but who cannot use that money or carry out the transfer, the most critical point is <b>correctly identifying which legal source the restriction applied to the account arises from<\/b>.<\/p>\n<ul>\n<li><b>The bank&#8217;s contractual restriction on the transaction (compliance risk)<\/b>,<\/li>\n<li><b>The postponement decision of the Minister of Treasury and Finance (Law No. 5549, Art. 19\/A)<\/b>,<\/li>\n<li><b>Judicial seizure based on a judge&#8217;s decision (CCP Art. 128)<\/b>,<\/li>\n<\/ul>\n<p>Each of these processes is subject to an entirely different legal regime under Turkish law; <b>each has its own authority for objection, its own application procedure and its own mandatory time limits<\/b>.<\/p>\n<\/div><\/div><div class=\"w-separator size_small\"><\/div><div class=\"w-iconbox us_custom_aea21514 iconpos_left style_default color_secondary align_left no_title\"><div class=\"w-iconbox-icon\" style=\"font-size:30px;\"><i class=\"far fa-gavel\"><\/i><\/div><div class=\"w-iconbox-meta\"><div class=\"w-iconbox-text\"><p><a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=5549&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\"><b>Law No. 5549 on the Prevention of Laundering Proceeds of Crime <\/b><\/a><\/p>\n<p><strong>ARTICLE 17 &#8211; <\/strong>(1) Where there is strong suspicion that the offence of laundering or of financing terrorism has been committed, assets may be seized in accordance with the procedure laid down in Article 128 of the Code of Criminal Procedure No. 5271.<\/p>\n<p style=\"font-weight: 400;\">(2) <strong>(Amended: 27\/12\/2020-7262\/24 art.) <\/strong>Where delay is prejudicial, the public prosecutor may also issue a seizure order. A seizure carried out without a judge&#8217;s decision is submitted for the approval of the competent judge within twenty-four hours. The judge decides at the latest within twenty-four hours whether or not to approve it. If the judge approves it, the report on the value referred to in Article 128 of the Code of Criminal Procedure No. 5271 dated 4\/12\/2004 is obtained within three months and submitted again for the judge&#8217;s approval. If it is not approved, or if the report cannot be obtained within three months, the decision of the public prosecutor&#8217;s office becomes null and void.<\/p>\n<p style=\"font-weight: 400;\">(3) <strong>(Added: 27\/12\/2020-7262\/24 art.) <\/strong>Irrespective of whether the offence of laundering has been committed within the framework of the activities of an organisation, an undercover investigator may be assigned in accordance with the provisions of Article 139 of the Code of Criminal Procedure, and the measure of controlled delivery may be ordered in accordance with the provisions of Law No. 4208.<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_auto\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_grid cols_1 laptops-cols_inherit tablets-cols_inherit mobiles-cols_1 valign_top type_default stacking_default\"><div class=\"wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_text_column us_custom_275474cc has_text_color\"><div class=\"wpb_wrapper\"><h2><span class=\"ez-toc-section\" id=\"WHAT_IS_MASAK_IN_TURKEY_AND_WHAT_POWERS_DOES_IT_HAVE\"><\/span>WHAT IS MASAK IN TURKEY AND WHAT POWERS DOES IT HAVE?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><b>MASAK<\/b> is the <b>Financial Crimes Investigation Board<\/b> operating within the <b>Ministry of Treasury and Finance<\/b>. This administrative unit, which <b>Article 2 of Law No. 5549 on the Prevention of Laundering Proceeds of Crime<\/b> defines in short as <strong>&#8220;the Presidency&#8221;<\/strong>, is Turkey&#8217;s national <b>central financial intelligence unit (Financial Intelligence Unit &#8211; FIU)<\/b> in combating <b>the laundering of proceeds of crime (money laundering)<\/b> and <b>the financing of terrorism<\/b>.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"1_The_Legal_Character_of_MASAK_and_the_Limits_of_Its_Duties_in_Turkey\"><\/span>1. The Legal Character of MASAK and the Limits of Its Duties in Turkey<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The biggest mistake made in practice is <b>perceiving MASAK as a criminal investigation authority or a judicial law enforcement unit<\/b>. Under Turkish law, MASAK&#8217;s legal status and field of duty lie within the following limits:<\/p>\n<ul>\n<li><b>It has no power to investigate or to file an indictment:<\/b> <b>MASAK is not a law enforcement body or a prosecution unit<\/b>. It does not carry out a criminal investigation itself, <b>it cannot apply the measure of detention or arrest<\/b>, <b>it cannot draw up an indictment<\/b> and <b>it cannot impose a criminal penalty<\/b>.<\/li>\n<li><b>It is a financial intelligence and analysis authority:<\/b> Its basic duty is <b>to analyse<\/b> the <b>Suspicious Transaction Reports (STR)<\/b> coming from <b>obliged parties<\/b> <strong>(banks, payment institutions, notaries public, crypto asset service providers and so on)<\/strong> and the public and private sector data it can access itself.<\/li>\n<li><b>It sets the judicial mechanism in motion:<\/b> Where the analyses carried out reveal <b>reasonable indications that proceeds of crime exist or that there is a suspicion of laundering<\/b>, the matter is recorded in a <b>Laundering Investigation Report<\/b> and <b>sent to the competent Chief Public Prosecutor&#8217;s Office<\/b>. In this respect MASAK is <b>an administrative preliminary review and reporting authority that starts the criminal process in the Turkish legal system<\/b>.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"2_What_Powers_Does_MASAK_Have_Under_Law_No_5549_in_Turkey\"><\/span>2. What Powers Does MASAK Have Under Law No. 5549 in Turkey?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>MASAK is equipped with a broad <b>power to collect information and to take administrative measures<\/b> in order to <b>secure the transparency of the financial system<\/b>.<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><b>Power to request information and documents (Arts. 6 &amp; 7):<\/b> Public institutions, banks, financial institutions and natural and legal persons <b>are obliged to provide<\/b> <b>any information, document and record requested by MASAK<\/b> without taking refuge in commercial or professional secrecy.<\/li>\n<li><b>Power to postpone \/ suspend suspicious transactions (Art. 19\/A):<\/b> Where financial transactions carry a suspicion of laundering or of financing terrorism, or <b>there are reasonable grounds that they derive from assets connected with those offences<\/b>, <b>MASAK has the power, with the approval of the Minister of Treasury and Finance, to suspend or postpone them for 7 business days<\/b>.<\/li>\n<li><b>Power of on-site supervision and examination (Art. 11):<\/b> Through tax inspectors, customs inspectors, sworn bank auditors and BRSA experts it <b>may have on-site supervision and a laundering examination carried out at the obliged parties<\/b>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<div style=\"width: 100%; It has the power to collect information, to postpone a transaction and, where necessary, to notify the judicial and administrative authorities under Turkish law.<\/div>\n<\/div>\n<h2><span class=\"ez-toc-section\" id=\"WHERE_DOES_MASAK_OBTAIN_ITS_INFORMATION_IN_TURKEY\"><\/span>WHERE DOES MASAK OBTAIN ITS INFORMATION IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>MASAK&#8217;s <b>basic data source in its financial intelligence gathering and analysis work<\/b> is the <b>&#8220;obliged parties&#8221;<\/b> listed in <b>Article 2 of Law No. 5549 on the Prevention of Laundering Proceeds of Crime<\/b>.<\/p>\n<p>These actors, which sit at the key points of the financial system and of commercial life, <b>bear administrative and criminal liability<\/b> for <b>preventing the laundering of assets that are the subject of an offence<\/b>.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"1_Which_Institutions_Are_Obliged_to_Provide_Information_to_MASAK_in_Turkey\"><\/span>1. Which Institutions Are Obliged to Provide Information to MASAK in Turkey?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Under Turkish legislation, the main obliged parties that must <b>monitor financial movements<\/b>, <b>carry out identification<\/b> and <b>report suspicious situations<\/b> are the following:<\/p>\n<ul>\n<li><b>Financial institutions and banks:<\/b> Deposit and participation banks, capital market intermediary institutions, portfolio management companies, insurance and reinsurance companies.<\/li>\n<li><b>The payment and digital finance sector:<\/b> Payment institutions, electronic money institutions (FinTech) and crypto asset service providers (crypto exchanges).<\/li>\n<li><b>Members of the independent professions and intermediaries:<\/b> Notaries public, jewellers, real estate advisers\/estate agencies and, under certain conditions, independent accountant financial advisers (SMMM) and sworn-in financial advisers (YMM).<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"2_What_Are_the_Core_Obligations_of_Banks_and_Other_Obliged_Parties_in_Turkey\"><\/span>2. What Are the Core Obligations of Banks and Other Obliged Parties in Turkey?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><strong>Law No. 5549<\/strong> places two main legal duties on obliged institutions in combating proceeds of crime:<\/p>\n<ol>\n<li><strong>The duty to know the customer (Law No. 5549, Art. 3 \/ <em>Know Your Customer &#8211; KYC<\/em>):<\/strong> Before a permanent business relationship is established, or in transactions exceeding certain monetary thresholds, obliged parties must identify <strong>the persons carrying out the transaction, the third parties on whose behalf they act and<\/strong> <strong>the real beneficiary (<em>Ultimate Beneficial Owner<\/em>)<\/strong>. Where the documents submitted in this framework are <strong>forged or contradictory<\/strong>, this is a ground for stopping the transaction.<\/li>\n<li><strong>The duty to file a suspicious transaction report (Law No. 5549, Art. 4 \/ <em>Suspicious Transaction Report &#8211; STR<\/em>):<\/strong> Where there is any <strong>information, suspicion or matter requiring suspicion<\/strong> that the assets subject to a transaction carried out or attempted before an obliged party have been obtained by unlawful means or are being used for unlawful purposes, the matter is immediately reported to MASAK.<\/li>\n<\/ol>\n<blockquote>\n<p>Under the <strong>confidentiality requirement (Art. 4\/2)<\/strong>, obliged parties <strong>may in no way disclose to the customer who is party to the transaction, or to third parties<\/strong>, that they have filed a suspicious transaction report with MASAK. For this reason banks operating under Turkish law, instead of telling a customer whose account has been stopped <strong>&#8220;we have filed a report with MASAK&#8221;<\/strong>, generally give the reason as <strong>&#8220;a compliance restriction or a document review&#8221;<\/strong>.<\/p>\n<\/blockquote>\n<h2><span class=\"ez-toc-section\" id=\"IS_A_SUSPICIOUS_TRANSACTION_REPORT_NOTIFIED_TO_THE_PERSON_IN_TURKEY\"><\/span>IS A SUSPICIOUS TRANSACTION REPORT NOTIFIED TO THE PERSON IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>A suspicious transaction report is not notified to the person.<\/strong> It is not legally possible for a suspicious transaction report (<strong>STR<\/strong>) to be <strong>communicated or notified<\/strong> to the person carrying out the transaction or to the holder of the account.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"1_Why_Is_Confidentiality_Essential_in_a_Suspicious_Transaction_Report_in_Turkey\"><\/span>1. Its legal source is the bank&#8217;s own internal risk\/compliance policies and <b>the terms of the Banking Services Agreement<\/b> concluded between the parties.<\/li>\n<li><b>The bank itself is the counterparty:<\/b> For a solution, <b>no application is made to the judicial authorities or to MASAK<\/b>. The counterparty is <b>the Compliance Unit and Operations Centre of the bank<\/b> where the transfer took place or where the account is held.<\/li>\n<li><b>It is the type of restriction resolved fastest:<\/b> Where supporting documents showing <b>the legal and economic justification<\/b> of the transaction and <b>the source of funds (Source of Funds)<\/b> are prepared and submitted consistently and in full, the restriction <b>is lifted by the bank itself, with no need for a judicial or administrative decision<\/b>.<\/li>\n<li><b>Its strategic importance:<\/b> At this stage <b>the written defence and the index of documents submitted to the bank are extremely critical<\/b>. Contradictory or inadequate statements given here cause the bank <b>to file a Suspicious Transaction Report (STR)<\/b> and pass the file straight to MASAK and to the judicial authorities.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"2-_How_Is_a_Postponement_of_a_Transaction_Originating_with_MASAK_Recognised_in_Turkey\"><\/span><b>2- How Is a Postponement of a Transaction Originating with MASAK Recognised in Turkey?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><b>The postponement based on Article 19\/A of Law No. 5549<\/b> is <b>an administrative act resting on the approval of the Minister of Treasury and Finance and is limited to a maximum of 7 business days<\/b>.<\/p>\n<p>This measure allows the transaction to be suspended temporarily <b>so that the financial intelligence analysis can be completed<\/b>. <b>When the statutory postponement period of 7 business days expires<\/b> the process ends in one of two ways:<\/p>\n<ul>\n<li><b>Where the suspicion falls away:<\/b> If the review shows that the transfer rests on a legitimate economic justification, <b>the administrative postponement of transactions becomes null and void automatically at the end of the 7 business days<\/b> and the restriction on the account is lifted.<\/li>\n<li><b>Where the matter passes to the judicial stage:<\/b> If the suspicion is confirmed or a need for further review arises, <b>the file is referred to the Chief Public Prosecutor&#8217;s Office<\/b>. At this stage the restriction ceases to be an administrative act and <b>turns into a judicial protective measure<\/b>.<\/li>\n<\/ul>\n<p><strong>The situation right holders meet most often in practice is that the bank account is still not open for use even though the statutory period of 7 business days has expired.<\/strong> This <b>does not mean that the administrative postponement period has been extended<\/b>; indeed, the law contains no provision allowing <strong>the 7-business-day period to be extended<\/strong>. What Is the Legal Basis of Seizure in the Money Laundering Offence in Turkey?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>One of the points most often confused in practice and in the legal literature is <b>the direct statutory basis of judicial seizure in the money laundering offence<\/b>.<\/p>\n<ul>\n<li><b>The catalogue offence limitation in CCP Art. 128:<\/b> In paragraph 2 of Article 128 of the Code of Criminal Procedure, headed <strong><i>&#8220;Seizure of immovable property, rights and receivables&#8221;<\/i> <\/strong>, the catalogue offences in which immovable property, rights and receivables may be seized <b>are listed exhaustively as a closed list<\/b>. The offence of <b>&#8220;Laundering of Assets Derived from Crime&#8221; under TPC Art. 282 does not appear in the catalogue in that paragraph<\/b>.<\/li>\n<li><b>The bridging provision (Law No. 5549, Art. 17):<\/b> The legal basis on which bank accounts and assets may be seized in the money laundering offence is <b>Article 17 of Law No. 5549<\/b>. By expressly providing that, <b>where there is strong suspicion<\/b> that the offences of laundering and of financing terrorism have been committed, a protective measure may be applied in accordance with the procedure in CCP Art. 128, this article <b>sets the judicial mechanism in motion<\/b>.<\/li>\n<\/ul>\n<h4><span class=\"ez-toc-section\" id=\"b_Who_Can_Apply_a_Judicial_Seizure_Measure_in_Turkey\"><\/span><b>b. Who Can Apply a Judicial Seizure Measure in Turkey?<\/b><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>In the judicial seizure measure applied under CCP Art. 128, <b>the deciding authority and the procedure are subject to the following rules.<\/b><\/p>\n<ul>\n<li><strong>Only a judge can order a seizure:<\/strong> Under paragraph nine of CCP Art. 128, <strong>only a judge can order a seizure under the provisions of that article<\/strong>; in the investigation stage the competent authority is <strong>the Criminal Judgeship of Peace<\/strong>. <em>(Legislative history: By the amendment made in 2016 by Article 25 of Law No. 6763, the earlier requirement of <strong>&#8220;a unanimous decision by the High Criminal Court&#8221;<\/strong> was repealed.)<\/em><\/li>\n<li><strong>The prosecutor&#8217;s temporary power of seizure arises not from CCP Art. 128 but from Law No. 5549, Art. 17\/2:<\/strong> Specifically for the offences of laundering and of financing terrorism, where delay is prejudicial, <strong>the public prosecutor may also issue a written seizure order<\/strong>. A seizure carried out on the prosecutor&#8217;s order is submitted for the approval of the competent judge <strong>within 24 hours<\/strong>; <strong>the judge also gives a decision within 24 hours.<\/strong> If the judge does not approve it, the measure lapses at once. This exception applies only to the offences covered by Law No. 5549; <strong>no such power is given to the prosecutor in the catalogue offences of CCP Art. 128 itself.<\/strong><\/li>\n<li><strong>The mandatory report requirement (CCP Art. 128):<\/strong> Before a seizure order can be given, it is <strong>mandatory to obtain a report<\/strong> on the value obtained from the offence from, as relevant, <strong>the Banking Regulation and Supervision Agency, the Capital Markets Board, the Financial Crimes Investigation Board, the Treasury and the Public Oversight, Accounting and Auditing Standards Authority<\/strong>. The report is prepared within three months at the latest; where special reasons require it, this period may be extended on request for a further <strong>two months<\/strong>. This pattern of conduct is defined in compliance software and monitoring systems as <b>an independent risk indicator<\/b> and <b>triggers a more intensive review<\/b> than a single high-value transfer.<\/p>\n<ul>\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Leaving_the_Banks_Letter_Unanswered_in_Turkey\"><\/span>Leaving the Bank&#8217;s Letter Unanswered in Turkey<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ul>\n<p>Leaving a request for information and documents unanswered <b>does not result in the restriction lapsing automatically<\/b>. On the contrary, because the suspicion cannot be dispelled, it <b>increases the likelihood that the file will pass to the judicial authorities<\/b>. At later stages it becomes impossible to prove what explanation the account holder gave and on what date.<\/p>\n<p>This is not merely a practical piece of advice. In its settled case law the <b>Constitutional Court<\/b> states that Article 35 of the Constitution covers <strong>&#8220;the guarantee that the owner will be afforded the opportunity to put forward effectively, before the responsible authorities, their defence and objections that the interference was applied unlawfully, arbitrarily or unreasonably&#8221;<\/strong>. <b>The effectiveness of the defence depends first of all on its having been put on record.<\/b> For this reason every explanation must be made <b>in writing and with a delivery record<\/b>, in a way that can be proved as to date and content.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"HOW_LONG_DOES_A_MASAK_REVIEW_AND_A_BANK_ACCOUNT_BLOCK_LAST_IN_TURKEY\"><\/span>HOW LONG DOES A MASAK REVIEW AND A BANK ACCOUNT BLOCK LAST IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>For a MASAK investigation the statutory framework is relatively short. <b>The postponement under Article 19\/A of Law No. 5549 is limited to seven business days<\/b> and <b>the suspension of the account under CCP Art. 128\/A to forty-eight hours<\/b>.<\/p>\n<p><strong>In practice, by contrast, a bank account freeze is seen to leave the account unusable for far longer.<\/strong> The reason for this is not an extension of the statutory period but <b>a change in the legal source of the restriction<\/b>. If the file has passed to a judicial authority by the time the administrative postponement period expires, the frozen bank account <b>now continues as a seizure measure<\/b>, and for seizure the law lays down no period in the nature of an upper limit. <strong>From this point on, what determines the length is<\/strong> <b>the course of the investigation<\/b>.<\/p>\n<p>That the period is not unlimited is the most important safeguard in this field. <b>The Ay\u015fe Sabahat Gencer judgment of the Plenary of the Constitutional Court, application no. 2018\/34950, dated 20\/10\/2022<\/b> <i>(Official Gazette: 11\/01\/2023-32070)<\/i> sets out this criterion clearly.<\/p>\n<p>In the case that gave rise to the judgment, the amount of a participation fund at a bank transferred to <strong>the Savings Deposit Insurance Fund<\/strong> was blocked as a measure by an administrative decision based on the provisions of Banking Law No. 5411, and this restriction continued for <b>a period exceeding five years and four months<\/b> <strong>(24\/11\/2016 &#8211; 4\/4\/2022).<\/strong> Although the judgment does not concern a MASAK block directly, <strong>the proportionality criterion it sets out applies to all administrative measures over assets under Turkish law.<\/strong> The Constitutional Court stated that, for measures placed on people&#8217;s assets to be regarded as proportionate, <b>the measure must have a reasonable justification<\/b> <strong>and, in addition, the reasons justifying the continuation of those decisions must also be set out<\/strong>. As a rule the period <b>starts on the day following the date of written notification<\/b>.<\/p>\n<p>Because the seven-business-day postponement period is short, in practice this route is mostly <b>used after the measure has ended<\/b>. The offence of laundering is laid down in <strong>Article 282 of Turkish Penal Code No. 5237, <\/strong>headed <i>&#8220;Laundering of assets derived from crime&#8221;<\/i> <b>, and two basic conditions must be met for it to arise<\/b>.<\/p>\n<ul>\n<li><b>What does the predicate offence condition mean?:<\/b> The asset that forms the subject of the offence must <b>derive from an offence carrying a minimum penalty of six months&#8217; imprisonment or more<\/b>. For an asset that does not derive from a predicate offence, <strong>no money laundering offence arises.<\/strong> For this reason, documenting a transfer that rests on a legitimate economic relationship <b>removes the material element of the offence from the outset<\/b>.<\/li>\n<li><b>Why is the specific intent condition decisive?:<\/b> <strong>The judgment of the Criminal General Assembly of the Court of Cassation, case no. 2015\/172, decision no. 2018\/435, dated 16.10.2018<\/strong> concerns in essence the power of the Ministry of Treasury and Finance to join a public prosecution brought for the offence of laundering and to appeal against the verdict; the judgment also sets out the structure of the offence in detail. According to the statement of reasons for the article quoted in the judgment, the offence is one with <b>alternative acts<\/b> and the two alternative acts are distinguished from one another: As regards <b>taking the assets out of the country<\/b> the intent of the perpetrator is regarded as sufficient, while as regards <b>subjecting the assets to various transactions<\/b> what is decisive is the aim pursued during those transactions; here <b>the purpose of concealing the illegitimate origin of the assets or of creating the impression that they were obtained by legitimate means<\/b> is required. In the same judgment the Criminal General Assembly emphasised that the legal interest protected by the offence is <strong>to enable the investigation and prosecution authorities to reach the assets obtained from predicate offences<\/strong> and that the offence being placed in the <strong><i>&#8220;Offences Against the Judiciary&#8221;<\/i> <\/strong>section reflects that choice.<\/li>\n<\/ul>\n<p>When these two conditions are assessed together, <b>it is clear that the act of receiving money from abroad does not in itself constitute an offence under Turkish law<\/b>.<strong> What is decisive is the source of the money and the purpose of the transaction.<\/strong> Focusing the review on these two points means that the defence must also be built on them. <strong>If the allegation of a predicate offence is based, for example, on fraud, whether the elements of <a href=\"https:\/\/www.cbhukuk.com\/en\/fraud-crime-in-turkey\/\">the offence of fraud<\/a> are made out must also be discussed separately.<\/strong><\/p>\n<h2><span class=\"ez-toc-section\" id=\"WHY_IS_LAWYER_SUPPORT_IMPORTANT_IN_A_MASAK_INVESTIGATION_IN_TURKEY\"><\/span>WHY IS LAWYER SUPPORT IMPORTANT IN A MASAK INVESTIGATION IN TURKEY?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><strong>A MASAK investigation is conducted in an extremely technical field where administrative law, criminal procedure law, banking legislation and <a href=\"https:\/\/www.cbhukuk.com\/en\/legal-services\/tax-lawyer-in-turkey\/\">Turkish tax law<\/a> intersect<\/strong>.
