TURKEY<span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><strong>Renting out homes on a daily basis for tourism or short stays without a permit is prohibited under Turkish legislation.<\/strong> Under <b>Law No. 7464 on the Rental of Residences for Tourism Purposes and Amendments to Certain Laws<\/b>, dated 25\/10\/2023, <strong>all short-term rentals of 100 days or less<\/strong> have, since 1 January 2024, been <strong>subject to obtaining a permit<\/strong> from the Ministry of Culture and Tourism.<\/p>\n<p>According to Ministry of Culture and Tourism data following the introduction of the permit requirement, as of the end of August 2024, the year the rules took effect, <b>only 37,172 of the 88,730 homes<\/b> that applied <strong>could be issued a permit.<\/strong><\/p>\n<p>One of the main practical reasons why more than half of the applications did not turn into a permit is the failure to obtain the <b>unanimous decision of the flat owners<\/b> required by Article 3 of Law No. 7464. The address is inspected by law enforcement (Police\/Gendarmerie) or inspectors. <b>This track gives quick results and leads to an administrative fine being imposed;<\/b> however, it does not make the complaining neighbour a party to the proceedings.<\/li>\n<li><b>Private Law Track (COL and Neighbour Law):<\/b> Apartment owners <b>can go to court<\/b> over breaches of the Condominium Ownership Law and the management plan. Since 1 September 2023, <b><a href=\"https:\/\/www.cbhukuk.com\/en\/mediation-process-in-turkey\/\">having applied to mediation<\/a> is a precondition for filing a lawsuit<\/b> in all disputes arising from the Condominium Ownership Law.
